•E ~.! t , PLANNING COMMISSION RESOLUTION NO. 631 A RESOLUTION GRANTING FINAL DEVELOPMENT PLAN APPROVAL FOR A "PLANNED UNIT DEVELOPMENT" AND SUBDIVISIDN KNOWN AS DAISY CREEK VILLAGE, PHASE II (Applicant(s): Eric Artner Construction, Inc. {Map 37 2W 10AB, Tax Lot 6500 & 37 2W 10AD, Tax Lot 1000 Recitals Applicants} haslhave submitted an application far final plat approval for a Planned Unit Development and Subdivision on a 2.26 acre parcel located north of Ash Street, west of Highway 99, east of Glenn Way and south of West Pine Street, in the City of Central Point, Oregon. 2, On, December 7, 2004, the Central Point Planning Commission considered a Final Development Plan application, at which time the commission reviewed the City staff reports and recommendations for approval on the application. Naw, therefore: BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Approval Criteria. The requirements for approval of final development plan applications are set forth in CPMC Title 16 & 17, relating to informational requirements, zoning, lot dimension, access, and similar requirements. Section 2. Findin sand Conclusions. The Planning Commission finds and determines as follows: A. Final Develo ment Plan A royal. The application and final plat are in the correct form and contain all of the information required by CPMC 16.12. B. Applicable Law. This Planned Unit Development and subdivision in an R-3 coning district created 24 lots, in Phase II of Daisy Creek Village, and meet the following general requirements for: CPMC 16.10.010 et seq. -Tentative Plans CPMC 16.12.060 et seq. -Final Plat Approval CPMC 17.68.010 et seq. -Planned Unit Development C. Findings_of Fact. The final Development Plan is in substantial compliance with the earlier approved preliminary plan and the conditions imposed by the City. The final Development Plan shall continue to control the PUD after it is finished in accordance with CPMC 17.68.070. Section 3. Car~~ditic~nal ~pprUVal. A final development plan, containing in final fozrr- the information required in the preliminary plan shall be submitted to the Gity within six months of approval or by November 4, 2404. A six month extension zn:ay be gra~xted by the City upon the applicant's request and for good cause. 2. The project must comply with all applicable local, state, and federal regulations including, but not limited to, the Oregon Uniform Rire Code and Structural Specialty Code. 3. The applicant shall submit final landscaping, lighting and sign plans to the City for approval as part of the final development plan. A suitable landscape and irrigation plan shall show the types of tree's, shntbs, and ground cover that will be planted and the irrigation £or the development and maintenance of public greenways and the tot lotl private parks}. 4. The applicant shall submit a copy of the Covenants, Codes and Restrictions {CC&R's) or any comparable agreement governing the use, maintenance and continued protection of the PUD as part of the final development plan. 5. The applicant is required to form a homeowner's association, in accordance with Oregon state law, in order to manage and rriaintain private streets, common areas and open space in the Daisy Creek Village PUD. 6. The approval of the tentative plan shall expire one year on May 4, 2005 unless an application for final plat ar an extension has been received by the City. 7, The applicant shall comply with the fencing plan adopted by the Planning Comrr~ission. APPROVAL DATE: 6-2-2004 Commissioners: The following were special requirements established in the Public Works Staff report for Daisy Creek Village: existing ~n~rastructure: The Developer shall demonstrate that ail connections to existing infrastructure (i.e. streets; water, sanitary sewer, storm drain systems; natural drainage systems; etc.,} will eat interfere with or provide far the degradation of the existing effective level of service or operation of the infrastructure facilities, and that the existing infrrastructure facilities have either adequate capacities to accommodate the flows and/or demands imposed an the existing infrastructure as the result of the connection of the proposed development's infrastructure, or will be unproved by and at the expense of the Developer to accommodate the additional flows and/or den:~ands; while maintaining or improving the existing level of service of the affected facility, as approved by (as applicable), the regulatory agency, utility owner, and/or property owner involved. Sform Drairta~e rnfrastructure: The developer shall develop a facility plan £ar the storm drain collection and conveyance system which provides for run-off from and run-on onto the proposed development, any future development on adjacent properties, and any areas deemed by the City that will need to tie-into the proposed development's storm water collection and conveyance system.
