G91 A RESOLUTION GRANTING SITE PLAN APPROVAL FOR A TWO PI-IASE INDUSTRIAL PARK {Applicant (s}: Peugl~z Industrial Park} (37 2W O1 BD, Tax Lots 300, 400 & 700) RecitaMs 1. Applicants} has/have submitted an application for site plan approval on three (3) parcels with a total area of 3.33 acres located west of Table Rock Raad an property identified by Jackson County as Accounts i0I95078, 10195060 and 10195094 in the City of Central Point, Oregon. 2. On, May 2, 2006, the Central Point Planning Commission conducted aduly-noticed public hearing on the application, at which time it reviewed the City staff reports and heard testimony and comments on the application. Now, therefore; BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Sectian 1. Criteria Applicable,to,,Decision. The following chapters of the Central Point Municipal Code apply to this application: A. Chapter 1'1.48, M-1, Industrial District B. Chapter 17.72, Site PIan, Landscaping and Construction Plan Approval Section 2. Finding and Conclusions. The Planning Commission hereby adopts by reference all findings of fact set forth in the City staff reports, and concludes that, except where addressed in the conditions of approval, the applications and proposal comply with the requirements of the following chapters of the Central Point Municipal Code: A. Chapter 17.48, relating to uses, lot size,lat coverage, setback and building height. B. Chapter 17.72, relating to Site Plan, Landscaping and Construction Plan approval. Sectian 3. Conditional Approval. The application for site plan permit is hereby approved, subject to the canditions set forth on Exhibit "A", the Planning Department Staff Report which includes attachments, which is attached hereto by reference and incorporated herein, imposed under authority of CPMC Chapter 16.36. STAFF SOURCE: Tom Humphrey AICP, Community Development Director BACKGROUND: This item was continued from the previous Planning Commission meeting after a neighbor expressed concern about losing access to his property because of obstructions created by the new development. The legal disposition of a road easement was questioned but neither staff nor the Commission were able to resolve the issue at that time. The City annexed this property earlier in the year so that the owner could develop in Central Point, work directly with the City Departments and also take advantage of Central Point services. Since the last meeting, the applicant provided warranty deed information that confirms the existence of a SO foot wide area on Tax Lot 700 that has been set aside for road purposes. This is illustrated by the dashed lines on Attachment A. This area along with a 12 foot easement that crosses an adjoining parcel provides access to tax lots S00 and 1200 which acre owned by 3ackie Newby. Amore recent agreement has been recorded which allows for `cross-access' among the various phases of the Peugh Industrial Fazk but it was not intended to serve other tax lots. The older 50 foot `easement' may affect the development of Phases 3 and 4 as originally proposed but it does not appear to affect the development of Phases 1 and 2. Therefore, the owner has asked that the Commission consider only phases 1 and 2 at this time (see Attachment B}. The existing building on tax lot 400 would remain but be reduced in size to provide limited storage. A cabinet shop operates from the alder building but will relocate once new buildings are constructed. The applicant intends to use the old building until the later phases are reconsidered and developed (see Attachment A; revised site plan}. FINDINGS: The applicant's revised site plan (Attachment "A") can adequately meet all approval criteria as set forth in Section 17.44.020 provided the conditions of approval (Attachment E) are implemented. ISSUES: In considering an approval of this site plan application, the Planning Department has addressed the following issues: 1. The tax lots in question have numerous recorded access easements that are intended to benefit adjoining properties and/or the development site exclusively. Approval of phases 1 & 2 will not be in conflict with any of the recorded easements. The applicant has agreed to submit a separate Peugh Industrial Park 06025b Page 1 of 2 application for phases 3 & 4 at which time he expects to resolve access to the adjoining properties. 2. The existing structure an the project site is intended to be partially demolished in order to continue using it far storage. Part of it needs to be demolished in order for the new circulation plan in Attachment A to work correctly. As a condition of approval (Attachment E), the applicant will be required to obtain a building permit to demolish the building in whole or in part. 3. The landscape plan that was submitted to the Planning Department is not easily readable and appears to be inconsistent with the overall layout of the project site. The City will need a copy of the landscape plan that can be evaluated and a condition has been recommended. Roads and harks has the fo[fowirig comments: 1. A Commercial Road Approach Permit from Jackson County Roads is required for any new or improved driveways off Table Rook Road. 2. Utility Permits are required from Roads and Parks for any utility work within the county road right-of-way. 3. The applicant needs to provide a hydraulic report and plan for review and approve! by Jackson County Roads. Storm Qrainage to Table Rock Road is limited to that area currently draining to the roadside ditch. Please contact Nancy Coates of Jackson County Roads at 774-6261 or a drainage basin map. 4. The existing building an Tax Lot 400 is connected to this main line. There is also an S inch main line on Table Rocl< Road with a service stub to Tax t.ot 400. The existing connection must be located and sealed when the building is removed. Sewer service to the new buildings will require connections to the existing main lines. Individual buildings can share service lines provided the services are adequately sized and the buildings are located on the same tax lat. The existing service stubs cart be used tf they are conveniently located, or new connections to the main line can be made. Each new connection will require a permit from RVS and payment of related development fees. The property is within the NPDES Phase 2 Stormwater Quality management area and must comply with reievar~t starmwater quality guidelines.
