AN ORDINANCE AMENDING TI'T'LE 5 OF THE CGNI'RAL POINT' MUNICIPAL CODE
RELATING "['O BUSINESS LICENSES
THE PEOPLE OF TFIE CITY OF CENTRAi, POINT DO ORDAIN AS FOLLOWS:
Section 1. Chapter 5.04 of the Central Point Municipal Code is hereby amended as follows. Bold
face type indicates additions to and strikeouts indicate deletions to this chapter:

5.04.010 Definitions.
E. "City designee" means a person duly authorized by the City Administrator to
conduct the processing of business license applications .. .
5.04.030 Business licenses required. A. No persons, for himself themselves or as agents or
employees of another, shall do business within the city .. .
5.04.040 Applications. A. Applications for business licenses shall be submitted on forms to be
provided by the reearder city designee. Every appplication shall be signed by the owner or iris their
duly authorized agent and shall contain the following information:
1. Name of person or persons owning business;
2. Assumed business name, if any.
3. Address of business premises, or and business mailing list address, ;" `rmzfi=rci'tt;
4. Nature of business;
5. Number of employees as of date of application,-if-applicable;
6. Where the business .. .
5.04.050 Issuance. Upon receipt of a business license application and the required fee, the same
shall be forwarded to the city adrrmristra-ter designee who will cause the application to be reviewed
by the b r - -'-'- ; r °u,,,; al,~~, appropriate members of the city staff for
compliance by the proposed business e€ Fvith all applicable charter and ordinance provisions
including, but not limited to, building, zoning and public safety ordinances. Upon approval for
compliance, the application will then be forwarded to the city designee who
shall issue a business license to the applicant. Licenses so issued shall be valid until the thirtieth day
of September June following the date of issuance

5.04.070 Contents. Licenses shall be issued to the applicant in the none of the business to he
licensed and shall designate the nature of the business, the address, ~ , of the business premises
and the dates of issuance and expiration.. .
5.04.090 Fee--Term. A. The business license term shall be the twelve-month period beginning
on 8etaber July 1 ~` of each year and ending September June 30"' of the calendaz year next following.
B. If any business subject to the provisions of this chapter comes into existence, or for the first time
commences its operations within the city at any time after 9etaber .lanuary 1 s' (arafterJuly-1 ~ 1-995
of any business license period, the license fee payable in connection with
that business for the current business license period shall be prorated as of the beginning date of the
quarterly semiannual period during which the activity begins. The quarterly semiannual periods
for the purposes hereof shall begin on the first days of 6etflber, Januaiy~pri~rxl-.1aly of each year.
C. The license fee for any business taxed hereunder shall be computed by~addingte-using the City
of Central Point Business License Fee Schedule to inch~de a basic fe <

.For the purposes of this subsection .. .
5.04.091 Exceptions. The terms and provisions of this chapter shall not apply to the following
businesses or activities, which shall be governed by the sections of this code indicated:

B- A. Dances, Section 5.08.020.
B. Not for profit organizations, requesting a temporary permit for seasonal sales,
when the time period for such sales does not exceed thirty days in an annual permit
period. The applicant shall provide the City with documentation of its non-profit
status and written permission from the owner(s) of the property on which the sales
are to be conducted.
5.04.092 License Renewals. A. The city designee shall annually send a license renewal
notice to each business for which a license has been issued informing said business of the
expiration date of its current license and requiring that business to renew its license for the
following business year.
B. The city designee shall assess a late fee on any business license renewal that is not paid
within thirty days of the date of the renewal notice. The amount of the late fee shall be as set
forth in the City of Central Point Business License Fee Schedule.
5.04.095 Special events .. .
C. Such licenses shall be limited to a period of not more than five consecutive days. A sponsoring
organization shall not be issued more than three such licenses in a-e~fendar-year an annual permit
period.
D. The fee for such licenses shall be ۥrve-dallars-per-day as set forth in the City of Central Point
Business License Fee Schedule .. .
5.04.115 Transfers of business. If a business ownership or location is transferred, the
requirements ofthis section shall prevail ~-r °'~crzr>i~co A fee as set forth in the City of Central
Point Business License Fee Schedule shall be ch<u~ged for a transfer. The employee tee will not
be charged in the year of transfer unless employees are added, in which case a charge will be made
for the additional employees.
5.04.120 Business License Fee Schedule. All business license fees shall be determined using
the City of Central Point Business License Fee Schedule as set forth hereunder. 'I'bis fee
schedule may be amended from time to time by the City Council by resolution.
Section 2 Chapter 5.08 of the Central Point Municipal Code is hereby amended as follows. Bold

PUBLIC DANCES .. .
5.08.020 License. It is unlawful for any person to hold or conduct any public dance without first
obtaining a license therefor from the city reeorder designee.
- A license fee as set
forth in the City of Central Point Business License Fee Schedule shall be paid in advance of
the event. Such licenses shall be issued upon a finding by the city reearder designee that the
applicant understands the provisions ofthis chapter and has the ability to conform to its provisions.
The license shall in no case be transferable. The city reeerder designee shall, if he~mds it is found
that a license holder has failed to substantially follow the requirements ofthis chapter, withdraw said
license or refuse a request to renew said license, as the case maybe. Any refusal by the city reeerder
designee to grant a license and any withdrawal of a license by the city reearder designee maybe
appealed to the city council, and the council shall deternine said appeal based on the evidence
relating to whether or not provisions of this chapter have been violated or are not reasonably
expected to be followed. The city reeerder designee shall, where Ire-deems it is deemed necessary,
request the chief of police to make such investigation and render such investigative reports as are
deemed necessary by the reearEler city designee to perforn his the duties prescribed under this
chapter .. .
Section 3 Chapter 5.16 of the Central Point Municipal Code is hereby amended as follows. Bold

5.16.020 License--Application--Fee. Anyperson, firm or corporation engaged in the business of
plumbing in the city shall, before engaging in such business, apply to the city reeerder designee
for a license to engage in the business and shall pay a license fees by-adding-to as set forth in the
City of Central Point Business License Fee Schedule to include a basic fee -

Section 4 Chapter 5.20 of the Central Point Municipal Code is hereby amended as follows. Bold

SOLICITORS, CANVASSERS AND PEDDLERS
5.20.010 Definitions. A. A "canvasser" or "solicitor" is defined as any individual, whether a
resident of the city or not, traveling either by foot, wagon, automobile, motor truck or any other type
of conveyance, from place to place, from house to house or from street to street, taking or attempting
to take orders for sale of goods, wares and merchandise, personal property of any nature whatsoever
for future delivery, or for services to be furnished or performed in the future, whether or not such
individual has, carries or exposes for sale a sample of the subject of such sale or whether ire such
individual is collecting advance pa}nnents on such sale or not; .. .
5.20.030 Permit and license--Application--Fee. A. Applicants for pennit and license under this
chapter must file with the city reeerder designee a sworn application in writing (in duplicate) on a
form to be furnished by the city reeerder designee which shall give the following information:.. .
B. At the time of filing the application, a fees-dv'r'r~rs as set forth in the City of Central
Point Business License Fee Schedule shall be paid to the city reearder designee to cover the cost
of investigation of the facts stated therein.
5.20.040 Permit and license-Applicant investigation-Issuance .. .
B. If the applicant is found to have been convicted of one or more felonies or one or more
misdemeanors involving moral turpitude, the chief of police shall endorse on such application his
a disapproval and Iris the reasons for the same, and return the said application to the city reeerder
designee, who shall notify the applicant that Iris the application is disapproved and that no pennit
and license will be issued.
C. If the applicant is found to have been convicted of no felonies and no misdemeanor involving
moral turpitude, th chief of police shall endorse on the application Iris an approval, execute a pennit
addressed to the applicant for the carrying on of the business applied for and return said pennit along
with the application to the city reeerder designee who shall, upon payment of the prescribed license
fee, deliver to the applicant Iris the permit and issue a license. Such license shall contain the
signature and seal of the issuing officer and the class of license issued and the kind of goods to be
sold thereunder, the amount of the fee paid, the date of issuance and the length of time the same shall
be operative, as well as the license number and other identifying description of any vehicle used in
such soliciting or canvassing. The city reeerder designee shall keep a permanent record of all
licenses issued .. .
5.20.050 License--Fees. A. The license fee which shall be charged by the cityreeerder designee
for such license shall be as
set forth in the City of Central Point Business License Fee Schedule .. .
5.20.080 Record of violation. The chief of police shall report to the city reecmler designee all
convictions for violations of this chapter and the city recorder designee shall maintain a record for
each license and record the reports of violation therein.
5.20.090 Permit and license--Revocation.

2. Fraud, misrepresentation or false statement made in the course or carrying on his the
business as solicitor, canvasser or peddler; .. .
B. Notice of the hearing for revocation of a license shall be given in writing, setting forth
specifically the grounds of the complaint and the time and place of hearing. Such notice shall be
mailed postage prepaid to the licensee's at-kzis last known address at least five days prior to the date
set for hearing.
Section 5 Chapter 5.24 of the Central Point Municipal Code is hereby amended as follows. Bold

ADULT BUSINESSES .. .
5.24.050 License--Period. Licenses for adult businesses shall be for quarter semiannual periods
commencing on July 15`-I-~`; and January I"and-zhprtl--I~~` of each year. No license fee shall
be for less than the full three six-month quarter semiannual period.
5.24.060 License--Fees. The license fee to be charged by the city reeorder designee for an adult
business license shall be as set forth in the City of Central Point
Business License Fee Schedule.
Section 6. Chapter 5.28 of the Central Point Municipal Code is hereby deleted in its entirety.
Section 7 Chapter 5.33 of the Central Point Municipal Code is hereby amended as follows. Bold

MERCHANT POLICE AND PRIVATE DETECTIVES
5.33.090 License fee. A license shall be issued to each successful applicant upon payment of a
license fee °`~ as set forth in the City of Central Point Business License Fee
Schedule. The license fee shall be the same whether for a portion of a year or the whole thereof.
5.33.100 Conditions of licensing .. .
D. Tenn of License. All licenses issued hereunder shall be for a term of one year, fi•om teary

Section 8 Chapter 5.38 of the Central Point Municipal Code is hereby amended as follows. I3old

DRUG PARAPIIERNALIA
5.38.060 License Fee. Anyperson desiring to sell or give items designed or marketed foruse with
illegal cannabis or drugs shall pay a license fee a€twe-lmndredrleHars as set forth in the
City of Central Point Business License Fee Schedule.
Section 9. This ordinance shall take effect on the thirtieth day after its enactment by the City
Council.
