A R~SOLUTION DENYING A TENTATIVE PLAN APPROVAL
FOR A LAND YARTITION

1. Applicant(s) hasThave submitted an application for tentative plan approval for a land partition on
a 1.70, 4.40, and 2.22 -acre parcel, located on South Peninger Road i~~ the City of Cantral Point, Oregon.
2. On November 6, 2001, the Central Point Planning C~mmission conducted a duly-noticed public
hearing on the application, at which time it reviewed the City staffreports and heard testimony and
comments on ~lie application.
Now, therefore;
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL
PQINT, OREGON, AS FOLLOWS:
Se~tion 1. Denial Criteria. The requirements for approval of land partitions and tentative plans are
set forth in CPMC Title 16 and 17, relating to informational requirements, zoning, lot dimension, access,
and similar requirements.
Section 2. Findin~ and Conciusions 1'he Planning Commission finds and determines as follows:
A. Tex~tative Plan Re uirements. The applicarion and tentative plan are in the correct form
and contain all of the information required by CPMC 16.10.
B. Area and Width of Lot. This partitioning in an C-4 zone would have created 3 parcels.
All parcels meet the minimum area ( 5,000 square teet for interiot lots and 5,000 square feet for
corner lots) and width { 50 feet for interior lots and 50 feet for corner lots) requirements far lots in the zone
as set forth in CPMC 17.44, and suchparcels meet the general requirements for lots contained in CPMC
l 6.24.050.
Section 3. Denial. The application for tentative plan for land partition herein is hereby denied,
subject to the conditions set forth on Exhibits "A" and'B", attached hereto by reference incorporated herein,
imposed under authority of CPMC Chapter 16.36.

2'W 11A, Tax Lot 101. The subject pazcel to be sabdivided is located an C-4, Tourist tarid 4ffce
Professionat Zone District.
The Central Point Planning Cornm~ission wiu review the application of Tentative Subdivision to
determine if aII of the requ~rcmen#s af the CentraI Point Municipal Code can be met. If the
Conunission determines that ihe subdivision can 6e created, a tentative approval coutd be issuecl .
Once a tentative approval has been issued, ihe applicant must f le for a final plat of tiae su~ic~ivisi
within ane year of the Comtnission's decision, on
CRITERIA FOR DECISION
The requirements for Tentative Subdivisions are set forth in Chapter 15 of t~ie Centra[ Point
Mwucipal Code, relating to General Information, tentative pIan approval and conditions on tentative
PY~ apPro~a1. The proposcd pian is also reviewed in accordance to the Cit~'s pablic Works
Standards.

At the meeting, the Planning Cammission will review tlte applications, technical staffreports, hear
testimony from #he applicant, proponents, opponents, and hear argumenis vn the application. Any
testimany or written comments must be related to the criteria set forth above. At the conclasion of
the review the Pl~uung Commission may approve or deny the Tentative Partition. City regulatians
provide that the CenUral Point City Council be ixtformed about all Planning Camriussion decisions.
