City Council Meeting Minutes
September 9, 2004
I. REGULAR MEETING CALLED TO ORDER
Mayor Williams called the meeting to order at 7:00 p.m.

III. ROLL CALL: Mayor: Hank Williams
Council Members: Nate Banry, Dick Halley, Kay Harrison, Donna
Higginbotham, Bill Stults and Mike Quilty were present.
City Administrator Phil Messina; City Attorney Doug Engle; Public
Works Director Bob Pierce; Police Chief Jon Zeliff; Building Official
Lois DeBenedetti; Community Development Director Tom
Humphrey; and City Recorder Deanna Gregory were also present.
IV. PUBLIC APPEARANCES
Bob Bestul, SJL Construction
Mr. Bestul asked about the issue regarding stumps buried in Central Point East Subdivision.
He was not present at the last meeting when the Council made their decision. Mr. Bestul
stated that he was also concerned about comments made by staff to the news papers
concerning the fact that he knew about the debris and still proceeded with constructing
houses. He feels that city staff knew about the debris and should have done something
about it sooner.
Community Development Director Tom Humphrey explained the decision the Council made
at the last meeting instructing staff to proceed with citations for burying the debris according
to CPMC. He also stated that SJL approached the City fast year and asked if the easement
for a berm could be vacated. At that time staff informed him that it was a private easement
and he would have to discuss it with Mr. Grove. Apparently, Mr. Grove proceeded with the
vacation. The buried debris was located in that easement. He stated that the Code
Enforcement Officer and the City Attorney have decided there are no grounds to site Mr.
Grove regarding the debris. DEQ has jurisdiction over this violation and they have fined Mr.
Regan. Staff did not know the debris was buried until Mr. Bestul brought it to the attention
of Code Enforcement Officer Ron Barnett and Building Official Lois DeBenedetti.
Mayor Williams stated that the city did not know about the debris until it was brought before
the Council a few months ago. There is nothing else for the city to do regarding this issue.

Bill Stults made a motion to approve the consent agenda as presented. Nate Banry
seconded. Roll call: Nate Banry, yes; Dick Halley, yes; Kay Harrison, yes; Donna
Higginbotham, yes; Mike Quilty, yes; and Bill Stults, yes. Motion approved.
VI. ITEMS REMOVED FROM CONSENT AGENDA
No items were removed.
VII. PUBLIC HEARINGS, ORDINANCES AND RESOLUTIONS
A. Public Hearing -First Reading Continued - An Ordinance Amending the
Central Point Comprehensive Plan Map and Zoning Map at Scenic Avenue and
North Third Street (37 2W 3A6, Tax Lots 4800, 4900, 5000, and 5001)
Mr. Humphrey asked for a continuation of this item. Staff still has not received all the
information regarding the particulars of the connecting roads for the proposed subdivision.
The reports should be available for the next Council Meeting.
Kay Harrison made a motion to continue the first reading of an Ordinance Amending
the Central Point Comprehensive Plan Map and Zoning Map at Scenic Avenue and
North Third Street to the next Council meeting. Nate Banry seconded. Roll call: Nate
Banry, yes; Dick Halley, yes; Kay Harrison, yes; Donna Higginbotham, yes; Mike Quilty,
yes; and Bill Stults, yes. Motion approved.
B. Resolution No. 1035, A Resolution Extending the City of Central Point's
Worker's Compensation Coverage to Volunteers of the City of Central Point.
City Administrator Phil Messina stated that the City chooses to cover its public safety
volunteers and parks volunteers under Workers Compensation. CCIS requests that an
annual resolution be adopted by the Council stating the amount of volunteers to be covered.
Mike Quilty made a motion to approve Resolution No. 1035, A Resolution Extending
the City of Central Point's Worker's Compensation Coverage to Volunteers of the
City of Central Point. Dick Halley seconded. Roll call: Nate Banry, yes; Dick Halley, yes;
Kay Harrison, yes; Donna Higginbotham, yes; Mike Quilty, yes; and Bill Stults, yes. Motion
approved.
VIII. BUSINESS
A. Planning Commission Report
Community Development Director presented the Planning Commission report for
September 7, 2004:
The Commission approved a preliminary development plan and tentative
subdivision for 19 residential lots known as the Snowy Butte Meadows PUD. The
subject tax lots are located west of Snowy Butte Lane, north of Beall Lane and

adjacent to Griffin Creek in the R-1-6 and R-1-8, Residential Single Family zones.
The development proposes private streets with access from Snowy Butte Lane. One
lot will be late in open space and sidewalks will be extended into the development.
The Commission imposed conditions that included compliance with building code and local
agency approvals as well as the preparation and submittal of a landscaping and irrigation
plan which includes the preservation of significant trees and the addition of new ones along
the private street. Improvements on Snowy Butte Lane will not be deferred but will be
developed in conjunction with road improvements that are being designed by an
engineering firm hired by the City.
The Commission approved a tentative land partition for three residential lots owned
by Guy & Gloria Castellano. The subject tax lot is located at 460 Freeman Road,
north of Cedar Street in the R-1-6, Residential Single Family zone. The Commission
fielded questions from adjacent property owners about the addition of two new
homes to the neighborhood. They imposed conditions that guaranteed the logical
extension of infrastructure to the new tax lots and relied on staff to work out issues
of privacy at the time of building construction.
• The Commission continued an amendment to the previously approved Beebe
Woods PUD. Gordon and Erma Layton are asking to include their property in the
PUD as Phase IV which would add four single family "attached units" and bring the
development's total to 107 lots. The subject tax lots are located east of Hamrick
Road and between Parkwood Village Lane and Brookdale Avenue in the R-2,
Residential Two-Family zone. The additional lots and the Layton's home site would
take their access from Live Oak Loop, which is a private street in the PUD.
The Commission continued the hearing to their meeting in October to allow the Layton's to
work out some development details with Galpin, LLC.
Bill Stults made a motion to approve the Planning Commission Report as presented
for September 7, 2004. Kay Harrison seconded. Roll call: Nate Banry, yes; Dick Halley,
yes; Kay Harrison, yes; Donna Higginbotham, yes; Mike Quilty, yes; and Bill Stults, yes.
Motion approved.
IX. MAYOR'S REPORT
No report.
X. CITY ADMINISTRATOR'S REPORT
City Administrator Phil Messina reported that:
• he attended the RPS meeting
• he attended the Regional Public Managers meeting
• he has been working with Janet Trzop profiling for vacant positions

XI. COUNCIL REPORTS
Donna Higginbotham reported that she attended the RVCOG Board Meeting.
Kay Harrison reported that she attended the ODOT meeting on the Seven Oaks
Interchange.
Mike Quilty reported that:
he attended the meeting to discuss the Highway 62 bypass options.
he attended the ODOT meeting on Seven Oaks Interchange
he is working with Staff and FEMA regarding the new flood maps for Elk Creek
Bill Stults reported that:
the Meadows will be working with the City to create an LID for water line
improvements inside the Meadows.
XI1. DEPARTMENT REPORTS
Public Works Director Bob Pierce reported that:
• he has been working with Council Member Stults regarding the water issue and
creating an LID.
• the city has received a matching grant from the State Parks and Recreation Division
for the City's skate park. They are working on updating the cost estimates, some
of the items have increased.
• Pine Street between Hwy 99 and Haskell Street will be closed from 9:00 p.m. to
6:00 a.m. beginning September 13 - 18'h. This section will also b_ a closed for one
weekend the first of October.
• Staff will be constructing some improvements to Don Jones Park.
• Summerfield will soon have playground equipment.
• staff will be working on SDC reasessments
• the Second Street sidewalk and bike lane is almost complete
• parts have been located to install the Glenn Park bridge without disturbing the
creek.
Building Official Lois De Benedetti asked for a motion to abate a health and safety hazard
located at 255 N. Sixth Street. She explained the property is vacant and provided photos
showing the debris that has been dumped on the property. She stated that the owner is in
protective custody and the co-owner is not available. The request for abatement is to
remove the debris, and board up the house to stop the vandalism currently taking place.
Kay Harrison made a motion to begin abatement proceeding at 255 N. Sixth Street.

Community Development Director Tom Humphrey reported that:
• September 30th will be the final Stake Holders meeting for East Pine Street.
• the Highway 99 conceptual planning consultant has been selected.
• he hopes to begin interviews for Planning Manager in the next few weeks.
• staff will continue to meet with Galpin regarding Snowybutte Station
Police Chief Jon Zeliff reported that:
• he attended the Oregon Police Chief Conference in Eugene
• he has been working with Janet Trzop regarding promotion interviews
• the Central Point DARE Cruise will be Saturday September 11, 2004
• the bicycle patrol was a success over the summer. He presented a report on the
activity of the officers.
XIII. ADJOURNMENT
Bill Stults moved to adjourn, Mike Quilty seconded, all said "aye" and the Council Meeting
was adjourned at 8:28 p.m.
