input on the Greater Bear Greek Regional Plan, with the intent of forwarding a

conclusion of J~tckson County's compi~ehensive plan r~d land use re~,ulation ~ndinent
process.
Mr. Burt s~ressed that this was not a land use decision. Jackson County is goirng throu~h
a lanci use decision and therefoxe, any camments made by concerncd citizens will be
forwardeci to the Cou~cil and to the Jackson County Planning Commission by staf~: In
orcier to obtain "legal" standing in this matter, it is imperative that anyone with ~oncerns
go befare the Jackson County Planning Comrnission.
Since the City initially reviewed the draft plan, there have been son~e minar changes
made whioh we ~~vill disouss and consequently clear up any cancerns that eommiftee
members might have. Mr. Bu~t painted out that Jackson County wauld have the ultimate
respansibility for finalizing the plan and once it is adop~ed by thc Land Conscrv~,tion and
Developmcnt Commission (LCDC}, cach city invblved in thc process would bc
responsible for modifying its cornprehensive plan, preparing amendments and forwarding
the information along to LCDC who will conduct a review and take action.
Mr: Burt stated tliat the reason for this process is to taice a look at long range land needs
tc~ ~ccommodate projected increases in popuiatian and it is incurnhent up~n the
pfu~ticip~irts in the pr~eess to forvv~~•d any concel~s expressed at th~e public hearin~.
Dan Burt then presenled a slic~e presentation, recapping the key cansiderations vi th~e
Plan, i#s gaals, implementation of those gc~als, policies, gross aareag~ needs and land us~
dis~ri~aution in each of the proposed Urban Reserve areas.
Don Burt advised committee members that as ~ result of a Cibzens Advisory Conunittee
ineeting that w~s held on 1Vlarch 9, 2010, specific concerns were raised for
cons~deration. ,.the addition of one tax lot ta CP-4D. The taac lot is approximately one
acre in size, has a residence on il, anc~ is classii"ied as an excep~ian property; elaritication
of the land use designation for the Littl~ League fields and the Boy Scout headquart~rs in
CP-6B; and a property owner in CP-6A does not wish to be included in the Ur6an
Reserve Area. This property is also approximately ane aere in size azzd has a residence
on it.
Community Developmenl Director Tom Humphrey explained that this process has been
going on for over t~n y~ars. Mr. I~umphrey said that when a city adjusts its urban growth
boundary (UGB), under current State law the addition of new lands wauld come fram
urban reserve areas. If there were no urban reserve areas to draw from, the city would
then look to exeeption lands in o~~der ta acquire the aer~eage needed for develo~ment. By
creatin~ urban reserve areas, we don't have to ~o into exc~ption iands. It is harder to
develop exception lands. Larger parcels can be master planned and thc fiscal impaet of
eYt~nding services to properties is minimized.

The frst citi;~en lo come forward was Duane Mallams with questions ta staff regarding
the calculation of densities. Don Burt stated that the Plan's prap~sed density f4r Central
Poi~x~t ranged between 6.00 and 7.30 units per aere and this would be reflected in the
comprehensive plan. Ivir. Burt also pointed out the acreage for agricultural buffering
would need to eome out Qf the totai acreage. Ivlr. Mailarr-~ asked if the ~creage
calculation would be reduced hy the ntunber af existing i~esidents on properties that will
be brought in, fuid Mr. Burt explained to hitn how that would be ealculated.
Warren H~ri:on, 2S2S Scenic Avenue, came forward in support af the R~gional Plan and
stafed that he wanted lo be included. Katie Mallams was th~ next person to ~ome
forwaxd and expr~ss~d conc~rns about r~sourc;~ lands contain~d in CP-bA, Gibbon/Forest
Acres a,s an area of mutual conccrn and the proposed urbanization of the Tolo area (CF-
1B). Sheri Sonnen, 2130 Boes Avenue, came farward and stated that she would like to
have her ~roperty included in an urban reserve area in orderr to get city water. Larry
Martin, 2673 Taylar Road, came forw~rd in support of the Re~ional Plan. Tim
Higinbatham, 2744 Taylor Road, came forward in favor of the Reginnal Ylan, stating that
he ~hought it was remarkablc that people had stayed with the process all this time and that
tac,~t ~lc~n~ spoke to th~ integrity af the people invalved. Mr. Higinbotlnam continued that
he had an agricultural background in the Rogue Valley, and that it wasn't an area you
would go to on purpase for farming because af the prevalence of hard pan in the soil. He
felt that the term "open space" would be more appropriately used to desaribe a lot of the
proposed urban reserve I~nds.
The Pltuinin~ Commission took a short break ~'ram 7:15 p.m. to 7:25 p.m. June Broci~,
2815 Taylor Raad, came farward to say that she and h~r husband were very much in
fav~r of the Ptan.
The public hearing was then closed.
Tam Humpluey aslced to address sorne af the issues raised and explained that in thc
be~innin~ of the process, different land us~ areas wcrc look~d at. The Tolo area was
viewed as an ar~a of mutual concern and was projected for future growth. As a result, a
water line was extended ta that employment base. The County has zonsd the area for
future development as the City wauld be better able to manage this area and not the
County. There at~ a lot of unique qualities to t~~e Tol~ area, rnainly to be utilized as a
juncture of transportation facilities.
Gibban Acres is another ar~a considered for expansivn but is beyand one-half mile fron~
the existing UGB, would require significant infrastxucture improvements, and has many
environmental coneerns.
In respanse to a question raised by Mike OJive~~ about the potential far future farming in
the valley, Mr. Humphrey saad that w~e will preserve some agricultural lar~d for this
purpose but that the mast productivc areas wcre Scven Oaks and property along Bear
Creelc.

to prep~e a resolution to forward ta the City Cocu~cil, subject to any items of concern of
the Planning Commissian.
The Planning Cammassion then discassed issues raised by residents and were all in
agreemenl about adding the properf,y loeated at 2130 Boes Avenue to Urbttn Reserve
Area (U~tA} CP-4D and ohanging the land use designation of the Little Le~gue and Boy
Scout properties in URA CP-GB to refleot an institutianal land usc in order to protect the
eurrent use of the property from future development. The Commission then discussed the
Mallams proper~y ~n Herita~e Rond (CP-6A) and all a~reed that there was no
justiFcatian for creating an island within that URA and all comrnissioners agreed that
they wcre concerncd with the bigger picture.

whieh reflects the C~mmission's recommendations ~n the issues raised. Tim

VII, DISCUSSION
Tom I3umphrey advised that the City had entered into an Intergovei~nental A~reeme~rt
with the Rail Division and Jackson County fa~ the railroad crossin~ aC Twin Creeks.
Pending resolution of a few minar issues, we axe waiting to hear an a final order from the
railroad. '1'he crossing is slated to be signalized, and consfructic~n would build up th~ ro~d
ttt HighwAy 99.
Mr. Humphrey said that there ha~d been a s~ight increase in housing e~nstruetion in the
~o~~ ~~aa,400 range.
The Cheese Festival is taking place this weckend at the Rogue Creamery. In addition, the
Creamery is talkin~ about expanding its cold storage.

Cr~eater Bear Creek Regional PIan. A#~er takic~g testimony the Pl.annin~ Commission closed the public
heari.ng and moved ~o forward a favora,ble r~ecommer~dation ta the City Council subject to the following
modifications:
1. Add tax lot 3&2V~34~] 230 to CP-4D; and
2. Clarify the indented use of the Little League Fields and the Boy Scout property in CP-6B.
The Pla~uwig Comrniss~on directed staff to prepaze a final resolutian for considera~ion at the April G,
20I ~ ~~eetitt~;.

Exhibit "B" of the resalution contalns the f ru~ings supporting the Pla~ning Cv~n~nission's
recorruuendatian. It should be nated that the City's oonsider~tion of the Plan a~ this time is lirnite~ to
consistency with the Participant's Ag~eem~nt. As a land use decision the County is respc~nsible far
prepa~ring f nciings addressing consistency with all applicable state land use laws.

of Medford, Ashland, Central Point, Eagle Poinf, Phveruix and Talent, entered into a
collaborative xegional probiem-salving {RPS) process; and
~VHEREAS, the City of Cen~ral PQint (City), as a pa~ticipant in RPS, having signed a
Participants' Agreement identifying a regional land use pro6lem, establishin~ ~,oals
addressing the problem, oreatxng mee~a~s~ms for achieving such goa~s, and a system for
monitoring the implementafion and effe~tiveness of fihe thase gaals; a~d
WI~EREAS, the Greater Bear Creek V~lley Regional Plan (the "RPS Plan"}
contempla#ed by #he Participants' Agreement has been prapased under the provisions of

~. INTRUDUCTION
On December 22, 2U08 tlae City Council approved ~rdinance No. 1923 adopting the Bear
Creek Valley RegirnnaD Pro~lem Salving Agree,ment (the "Agr~ment"). The Agreement
set forth the terms and conditions agreed to by the City relative to implementatian af the
dra~ Plan as r~ferenced in the Agreement. The Agreemer~t fiu~er states that the ado ted
Plan sha~l be what is ~dapted a~ a result of Jackson County's comprehensive plan
amendment process~,
JackSOn County is currently in the p~ocess of conducting ~ s~ries of public hearin~s to
consider approv~l of compreh~nsive p~an and land use regulations necessary ta apprave
and implement the Plan, which upon adoption wiil beeome the adapbed Plan per the
Agreement. As p~rt of the County's review process the participating cities are provided
an oppot~tuni#y to review a final drafi ofthe Pl~n, ~nd will forward a recommendation to
#he County pl~nning commission regarding the Plan. Partieipating cities wi~l alsa be
given an opportunity for ora] comment befare the County planning coxnmission prior to
the Caunty's final decision.
The pwrpose of these findings is to eonfirm that the plan as presented in E~chibit "A" is
substantially cansisterit with the draft Plan presented in the Agreernent, and tv forvvaxd a
i~ecommendataon to the Caunty to approve the Plan as presented in E~ibit "A", with.
changes.
As used in these findings the follvwing terms are used in referencing the Cnreater Bear
Creek Va~ley RegionaZ PJ~n:
"Regiona~ Plan" -- A generic reference to the Greater Bear Creek R,egional Plan;
°~Agreement Plan" -- Ref~s to the Regional P~an approved as pat~ nf the Participants
Agreement;
'°Pending Plan" - Refers to th,e Regional Plan dated Novernber 2049 and the subject of
these findings; and
~~Adopted Plan" - Refers t~ the Regional Plan adopted by the County per the curc~ent
proceeciings, subject to LCDC acknowledgement an~d appeals.
lt is the pu~pase of these findings to de~ermine whether or nat the Pending P1an is
consistent with the Agreement Flan, and to recom.m~end any ohanges, and supportirag
findings, ~1iat are re~vealed during the City's publia hearing proeess.

The Greater Be~r Creek Valley Regional Problem Solving Agreement
("Agreement"} has been approved by the City~ and the Land Development and
Conservation Cammission on September 23, 2009~ The Agreetn~nt is an
ag~~eemeat by al~ participating cities that that they will abide by the Plan adopted
by the Implementing Signafiories and acknowledged by the State of Oreg~n. The
Agreement furth~r stipul~tes that the adopted Pla~n shall be the Plan adopt~~ as a
result c~f Jackson County's comprehensive plan ameadment process.
Appxoval of the Agreement included apptbval of the Agreement Plan, subject t~
any modifia~tions that may occur during the eomprehensive plan and land use
changes nec~ssary ta implement the Region Pla.n.
III. Statement of Problems to be Addressed
Finding: The Agi•eement identi~ea three problems to be addressed by the
Regionat Pl~;
Problem #1: Laek of a Mechatusm for Coordinated Regional Grawth;
Prablem #2: Loss af Valuable I'arm ~rtd Forest Land Caused by Urban Expans~on;
and
Problem #3: Loss ofCommunity Identi€3-.
These three problems we~•e addressed in the A~;reement draft Plan3. The pending
draft of Plaa~ restates these t~res prabiems verbatim~.
Conclusion: The pending dra#~ plan is consistent with fihe Agreement draft Plan.
IV, Praject Goals
F~nd~ng: The Agreement sets farth three gaals to be achieved by adoptian of the
Plan:
Gaal #1: Manage future regiona~ growth for the grea~er public goad;
Goal #'2: Conserve resouroe and open spaee l~nds for #heir impor~ant economic,
cultural, and livability benefits; and
C~oal #3: Recognize and empha~ize the individual iderrtity, unique feature.g, and

This Ur~an Reserve area eacists ~s a tria~gular-sha~sed ~ract that runs alang the northeastern side
of ittterstata 5. The area has approxit~ately 5~83 ~cres, approximately two•thirds of which is
curren~Iy desegnatecf Agricultural and is owned by Jaakson County. Ti~e southerly third of ti~e
are~ is designated as R~raE Resedential land and is owned by the City of Central Point. Both
~raats axe part of the Bear Creek Greenway. None of the land is or has in recent history been in
agricultur~l produotion and ti~e soils are af low agricultural suitabiiity {Class IV-VII, where not
built as roadway, or within fl~e Bear Creek floodway). This ~re~ alsa has environment~l

~eceived the property in Iieu of foreclasurc. The bank requesied and received a one year extension of
the original site plait approval to April 1, 2Q I0. 4n March 19, 20 ~ 0, the Applicant requested an
additional one year extension of the site plan. If gran#ed, the revised expiration dabe would be April 1,
201 ~. The Planning Commission may extend the site plan approva[ fc~r an additianal period vf one year
as provit~.ed by CPMC Section ~ 7.72.0'74.
Precedi~~g the original app~•ov~al of the site plasi application, the Appli.cant applied for and received a
tentative ~ve {5) ~ot subdivision plan for the project {File No. d7430). The tentative plan has since
expired. Any future proposals for subdividing #he property will require a new ten#ative plan application.
ISSUES:
