ATTENDEES Mayor: Hank Williams Council Members: Bruce Dingier, Mike Quilty, Matt Stephenson, Allen Broderick, Carol Fischer, and Kay Harrison were present. City Administrator Phil Messina; Parks and Recreation Manager Matt Samitore; Public Works Director Bob Pierce; Community Development Director Tom Humphrey; Assistant City Administrator Chris. Clayton; Floodplain/Storm water Coordinator Stephanie Woolett; and City Recorder Deanna Casey were also present. III. BUSINESS A. FIRMA/FEIIAA Flood leap Twin Cr®eks I~itlgation Plan Floodplain/Storm water Coordinator Stephanie Woolett explained the current time line for adoption of the new FEMA maps is September or October of 2010. She explained that a public open house was hosted by FEMA on August 20th and over 75% of the attendees were from Central Point. Due to the projected flood impacts along Griffin and Jackson Creeks associated with the new flood data, Twin Creeks LLC hired Northwest Hydraulic Consultants to conduct an analysis of potential mitigation alternatives. They have identified an option that would reduce the 100 year floodplain and floodway boundaries within the Twin Creeks Development and have minimal impacts downstream. The mitigation option included increasing the culvert capacity at Highway 99 and installing a large culvert underneath Twin Creek Crossing to connect a storm detention area near Griffin Creek with an overflow channel that runs parallel with the railroad tracks. At some point in the spring, depending on Asante's timeline, the City Council may be asked to adopt the civil improvement plans for the mitigation. This will coincide with the funding and construction of the new rail crossing. The FEMA map adoption, rail crossing and mitigation plans are all intertwined. If one portion is delayed the other parts will have to wait. Without these items being done the Asante property would be unbuildable. There are a few impacts to properties downstream from the bridge. B. Twin Creek Crossing Update Community Development Director Tom Humphrey explained that the city has worked for several years to get a rail crossing in the vicinity of Crater High School. In order to receive a final order for construction, ODOT requires the City to enter into an Intergovernmental Agreement with Jackson County which obligates them to close an existing rail crossing in favor of the new crossing at Twin Creeks. In order for the County to approve the IGA they required the City to enter into an agreement with the Dunn family regarding the closure of the Seven Oaks Crossing. The Board of Commissioners have accepted the offer for compensation between the Dunn family and the City. C. Jackson County Roads Jurisdiction Issues The County has determined that any local action requiring their approval will be accompanied by the jurisdictional transfer of a county road and/or rights-of-way. The County is asking the City to take jurisdiction of Freeman Road before they sign the IGA for the rail crossing. The City may have drawn attention to Freeman Road earlier this year which made its jurisdiction more of an issue for Jackson County. In any event the Board is resolute on this matter and has indicated. that it will expedite the IGA once the city assumes responsibility for Freeman Road. A resolution to accept jurisdiction of Freeman Road will be brought before the council. It should be explained that Freeman Road is not a high priority for the City and no funds have been set aside for either its maintenance or its improvement for the near future. The City does have a conceptual design for Freeman which was done in 2007. The Public Works Department estimates that it would cast $200K to overlay the road and preserve it for the next ten years. He stated that this study session is intended to introduce the Council to the latest in series of Board of Commissioners .policies which are affecting local transportation projects. The City's cooperation in jurisdictional transfers will result in a signed IGA, an ODOh Final Order and the authorization to begin construction on the Twin Creeks .Rail Crossing. Conclusion: Although staff and Council are not in favor of being forced to accept substandard .rights-of-ways from the County. they feel it is in our favor to do so this time.. Staff should return with a resolution and IGA for council approval. It would- look good fior the. City if we were the ones to make the .much .needed improvements to Freeman Road. IV.
