The Common Council met in regular adjourned session with Mayar Ivan
Burton presiding. Present were: Councilmen; Hill, Reed, Tonn and
Van Horn. Also present; City Administrator Tucker, Recorder .Zander,
Police Chief Sanders, Public Works Supt. Capps, Asst. Fire Chief
DeArmond, Fireman OConnor, and Sgt. Corliss.
Minutes of the previous meeting were presented to the mayor and.
council for their approval. Councilman Van-Horn moved to accept
the minutes as prepared. Seconded by Tonn. With all in favor,
motion carried.
At this time City Administrator Tucker introduced Mr. Ralph G. Eaton,
director, Housing Authority of Jackson County, to the mayor and
council. Mr.~Tucker briefed the council on Mr. Eaton~s presence and
interest with-the city of Central Point. Mr. Eaton spoke on the
U.S.- Housing Act (Sec. 23) relating to the cities allowing the Authority
to transact leases with private owners. His request being of securing
a resolution from the City to be able to Conduct the business within
the corporate limits. After a question and answer period, Mayor Burton
stated that attorney Mansfield would be contacted instructing him to
draw up a suitable resolution. All members of the council were in
accordance w~:th the Mayors suggestions.
Mayor Burton spoke to the 2 young men in attendance who have been
hired on the police dept. At this time they were asked to step
forward for their oath of office. Bill Robins and Troy Stubbs
were sworn in as City Police Officers by the mayor and were wished
good luck and success in their employment.
Mr. John W. Bour presented himself as a member of a new organization
known as "preserve our parks system". He spoke on the proposed
garbage dump in the Antelog~area (Dry Creek) as being most unsuitable,
also needing the city support in the form of a letter. Giving some
reasons as drainage from such would contaminate the lake down stream,
also the soil test showing to be of shallow and of sticky type. After
several questions from the table it was the councils feeling that
the City should aquaint themselves more with the issue as it has
been rather a county and city sanitary matter.
Correspondence was read from City Treasurer Lorain Tate wanting to.
know how to handle the payroll, as the council must approve the pay
for employees after they have received their checks. The wetter was
discussed and was directed to Administrative Chairman Hill and Mr.
Tucker for further study.

Minutes of the Planning Commission meeting were studied and discussed..
At this time°Attorney Paulson acting as counsel for Mr. & Mrs.. Gene
Skelton, introduced himself and asked for the council's time to be
heard on the Skelton matter.. Mr. Paulson stated that his clients had
been advised some time ago by the City Hall personel that it would be
alright to sell tropical fish at their newly planned home (being built)
on Ash Street. Since that time the Skeltons have made. application.
for the home occupation and were turned down by.the Commission dne to
certain restrictions (selling of products), With a recommendation by
the Commission to the council to-make a certain change in the variance
allowance of the Zoning Ordinance. Mayor Burton stated inasmuch that
attorney Mansfield was ill and unable to attend this meeting, it is
suggested that Tucker contact the legal department to study this
section of the Zoning Ordinance and recommend an amendment to.the
ordinance for the best interest of the citizens of Central. Point.
However, Mr. Mansfield would have to be contacted before arty changes
can be considered.
Councilman Hill spoke on the issues of "What is the intention. of x
Zoning ordinance?" Its for the benefit. and protection of the residents
within a zone designated for its purpose as written, not being opposed
to any variance but just stating what it really means.
Motion was made by Hill, seconded by Van Horn to adopt the wishes of
the Planning Commission in their request of a change of Sec. 1.200
allowing certain sales of goods on premises. With Attorney Mansfield
to draw up a suitable ordinance for approval by the council. With all
in .favor, motion carried.
Mayor Burton called upon Mr. Robert Lull for further information on
the City Granite pit level. Mr. Lull spoke in objection of certain .
areas of the proposed lease as it appears now. The term being. too
long (5 yrs.) as the.stateci annual rate over. the 5 year period. He
further explained that it very well could happen that a step up
in operations could remove all available material in a couple of
years and that he would have a remaining period of two or three
years to pay on a useless and dry pit. after lengthy .discussion
Mayor Burton called for the report of all Granite. receipts .from the
City Recorder. The Recorder advised that this is not .available at:
the moment, however, it will be presented as soon as possible. Mr. .
Lull was asked for any records he had available concerning previous
granite transactions with the city for further study. Mr. Lull stated
that he possibly owes the city for approximately 3 or 4 months
hauling in about $300.00. He also wanted to,know the present
conditions on how or what to do during the waiting period. The
council agreed for him to continue in operation and retain the records
of activity.
Mr. Tucker presented a proposed ordinance relating to the keeping of
animals and repealing Ord. 619 and .Ord. 920 and providing penalties.
Motion made by Tonn, seconded by Hill to accept the proposed ordinance.
.With roll call vote and all in favor, motion carried. Ordinance #964
,declared. duly adopted.

Mr. Tucker presented proposed ordinance for passage. An ordinance
relating to Signs and Advertising structures and amending Ord. 928,
Sec. 55, Sign Board'of Appeals. Motion made by Reed, seconded by
Tonn to adopt the proposed ordinance. Roll call vote indicated all
in favor. Motion carried. Ordinance 965~declared duly adopted.
Mr. Tucker. also requested passage. of a proposed ordinance in part: An
ordinance relating i~o Jury Trials and amending Ord. 858, Sec. l0.
After some discussion of the proposed ordinance, a motion. was made by
Tonn, seconded by Hill to adopt'the proposed ordinance. Roll call
vote indicated all in favor. Motion carried. Ordinance 966 declared
duly adopted.
Mr. Tucker stated that he and Chief Sanders met with Attorney Mansfield
concerning the latest legislation. on the indigent person accused of
committing violations of City and State laws and ordinances with the
right to counsel at the City~s expense. Mr. Tucker also read from
material secured from Medford City Attorney Roy Bashaw as setting
forth the eligible or.non-eligible persons for such representation.
After some discussion, it was recommended by the mayor that if no one
has"any objection to further the situation, a plan to draw a similar
form should be installed, and have Mr. Tucker and the City Attorney
proceed with the project.
A letter of comment was read by Mayor Burton from Chief of Police
Sanders, concerning namely Sgt. Jim Corliss and Officer George
Tomberlin for their fast and efficient efforts put into a burglary
investigation that led to an arrest of the responsible persons.
The police ..report was studied by the mayor and council, noting the
doubled activity in police work in recent months. Mayor Burton
complimented the department on the accomplishments achieved during
the short time ~,n a rather new maned department. Appreciation and
thanks wereFextended by Counci]man Hill to both the fire and police
departments for their joint efforts in the elementary school lectures
held recently.
Mr. Tucker advised that temporary repairs have been made to the
roof of the City Hall building.
The City Administrator presented a proposed change of lighting in
the school area crossing. The problem reported is inadequate lighting
at critical areas of Mae Richardson School. It was suggested that a
change of 7,000 lumen to 21,000 luman lights be made and relocate<:
one light pole to better light a crossing. Mr. Tucker further stated
that this was a council approved plan for lighting and should any
changes be considered again it should be done by council action.
Motion made by Tonn, seconded by Reed to make the necessary change.
With all in favor, motion carried.
Mr. Tucker advised the mayor and council that he'has located a
slightly used addressing office machine at a considerable savings
~budget_tem 1055). He also recommended the transfer of the unused

balance (budgeted) to the Building Construction fund for further
completion of the new shop. building. After further discussion a
motion was made by Van Horn, seconded by Tonn for any funds left over
after the purchase of addressing equipment be transferred to the shop
building: With all in favor, motion carried.
Mayor Burton asked tf all of the Liquor renewal applications have "
been presented for the councils action. Mr. Tucker stated that two
of the local package beer and wine retailers have not been received
to this date. It was recommended that the council would hold off
until the Nov. 18 meeting and in hopes that all of the merchants
have placed the forms with the city.
Mr. Tucker advised the council that Mr. Mansfield, City Attorney,
~ would poesibly attend the League meeting in Portland on Nov. 1b-18.
v--d If-it were the wishes of the council and if so, could an allowance
~ of expenses be provided. After discussion on expenses and how many
~ city dept. heads and councilmen would attend, a motion was made by
~ Hill, seconded by Van Horn to allow t~ttorney Mansfield $35.00 for
expenses'to.attend the League meeting.
Mr. Tucker. instructed the mayor and council regarding the necessity
of .additional traffic signs in the following areas: 1, a 15 m.p.h. sign
on S. 4th St. between Bush and Hopkins Road. This would be considered
a safe speed for the severe curve on 4th St. At present, 25 m~p.~i.
traffic in the curve puts the vehicle in the wrong lane, of traffic
or off the road way. The other area being West Pine St. entering the
city limits. Mr. Tucker expressed Ch~esf Sanders feeling and opinion
on an additional 25 m. p.~i. sign for further warning to the designated
speed when entering the city for motorists. This sign would be in
-the near'vicinity of West Pine and Corcoran Lane. On discussion it
was recommended by the council to approve the placement of the two
traffic signs as requested.
Mr. Tucker brought forth for discussion the problem of leaves on
the streets and ways of disposal. Mr. Capps stated that the street
sweeper: is not designed to pick up this type of removal. After
lengthy discussion it was well realized that this was an annual
problem for both the City Street Dept. and property owners. It was
the feeling of the council that burning after the lifting of fire
restrictions is the most practical way be the home owners. There was
no further action on the matter at this time.
A letter dated Sept. 29, 1969 signed by the City. Recorder Fd Zander
was read~by the Mayor. The contents being time off of the job Yrom
Oct. 1 through Oct. 10. This being 6 work days. Discussion was
held on the matter concerning the loss of time as an employee.
Motion-was made by Van Horn to dodk Mr. Zander for the g work days
from his'pay during his time away from his job. Without the move
of a second on the motion, Van Horn withdrew the motion. Mr. Hill
recommended that the Mayor be given the authority to meet with Mr.
Zander and work things out. Motion made by Hill, second by Tonn
,to 'have Mayor Burton meet with Mr. Zander and at the Mayors descretion
r. as to what action is to be taken to justify his absence.
