That the site is adequate in size and shape to accommodate the proposed use and to meet all other development and Iot requirements for the zoning district; and 2. That the site has adequate access to a public street that the street can effectively accommodate traff c that may be generated by the proposed uses; and 3. That the proposed uses (police substation) will have no significant adverse effect an abutting property ar the permitted uses thereof; and 4. That the conditions required for approval are deemed necessary to protect the public health safety and general welfare. In reviewing the request, rt has been determined that as presented, the police substation is in general compliance with the above key criteria (see Attachment "C" far detailed findings). Parking: Section 17.65.054, Table 3 allows the parking requirements for a community service civic use to be the number determined as necessary. The City Police Department requires on-street parking, and therefore the designated parking will not consume the retirement center's ofd street parking spaces. This proposal provides two (2) on-street parking spaces along Twin Creeks Crossing, adjacent to the retirement center (see Figure 1) for use by police vehicles. The police parking area will be pasted and the curb painted to specify police vehicle Barking only. FINDINGS; See attached Attachment "C" ISSUES: 1. No issues identified CONDITXONS OF APPROVAL: 1. Prior to the issuance of a Certificate of Occupancy for the Twin Creek Retirement Center the applicant shall designate, and mark, two on-street police vehicle parking spaces along Twin Creeks Crossing as illustrated in Figure 1. And revised staff repar# 3.6.07, Findings of fact, item C, pg2. 17.76.020 Information required. A. Twin Creeks Retirement, Oregon Limited Partnership 191$ Spring Street, Medford, Oregon 97504 B. Twin Creeks Retirement, O.L.P., is the owner of the property and Ron Grimes, a member of the "Partnership", is authorized to represent the owner. C. 888 Twin Creek Grassing Assessor's map number T37R2W03C, tax lot #100, lot 32 D. Drawings describing the site and improvements are attached. E. Included in the design is a police substation. The purpose of this use is to provide an enforcement presence in the local neighborhood. A sign, police car and substation space in the building would provide the desired presence. The substation is classified as a civic use and civic uses in the HMR district require a conditional use permit for the police substation prior to the occupancy of such space as a police substation. 17.76.040 Findings and Conditions A. "That the site far the proposed use is adequate in size and shape to accommodate the use and to meet all other development and lot requirements of the subject zoning district and all other provisions of this code;" The proposed police substation area contains an open office area and restroom facility totaling 338 square feet. This office is located with-in the main building of 984,258 square feet. The site 4.23 acres can accommodate the substation- The office will require one parking space, as shown on the site plan during the day and that space is street parking ar off site. District and others provisions of the zoning code. Therefore, since the police substation is proposed as part of the approved building it complies. B, "That the site has adequate access to a public, street or highway and that the street or highway is adequate in size and condition to effectively accommodate the traffic that is expected #o be generated by the proposed use". The site has direct access to Twin Creeks Crossing and Rustler Peek Street. Twin Creeks Crossing has a 46' wide paved section with two way #raffic. Rustier Peak Street has a 36' wide paved section with two way traffic. The proposed traffic would be volunteers staffing the station 3 times a week for approximately 4 hour periods. Officers would stop by 3-4 times daily at the rate of 3-5 times a week. The streets have adequate capacity to handle this additional load. C. "That the proposed use will have no significant adverse effect on abutting property or the permitted use thru of. In making this determination, the commission shall consider the proposed location of improvements on the site; vehicular ingress, egress and internal circulation; set back; height of building s and structures; walls and fences; landscaping; outdoor lighting; and signs". The abutting use of the property is currently being used as a large open grassy area used for football practice by high school, soccer games and generally an open space. The long term use of the space is zoned for civic use like a grade school. The proposed location of improvements on the site will be located on the south side of the retirement center, on the first floor and approximately 60' from the south-east corner of the building fronting on Twin Creeks Grassing. The proposed facility is an office where all activity takes place in side the building and the only activity would be the traffic generated by the police cars. The physical presence of law enforcement located directly across the street from a playground (current use) and a grade school (future use), would provide a secure influence an these activities. Vehicular ingresslegress will only occur in the public street and at their curb side parking space which will be painted red for identification. Again the presence of a police car will not adversely affect the local neighborhood. The maximum number of trips on any given day would be approx. 20. This is low traffiic movement to have a significant adverse effect. There would not be any internal circulation. The setback for this side of the building is from 0 feet to 15 feet. The project has a 10 foot setback which is acceptable. The maximum building height in this zone is 60'. The actual building height in this portion of the building is 38'-0". The 78'-0" wide public R.4.W. helps in reducing the 3 story effect of the proposed building on the abutting use. There are no walls or fences. The building is setback 10' from the sidewalk and will contain landscaping and trees. The sidewalk also has street trees and the two working together will soften the effect the building has on the use across the street (Twin Creeks Crossing). 2 Outdoor lighting is located in the sous of the covered walkway on the Southside of the building. This source of lighting will produce more dawn light that light aim off the property. There will be (1 }one sign located near the sidewalk. The sign will be a 3'X2'X3' above grade with a single ground light to provide visibility at night. This size of sign has little to no effect on the area across the street. D. "That fihe establishment, maintenance or operation of the use applied for will comply with local, state and federal health and safety regulations and therefore will not be detrimental to the health, safety ar general welfare of persons residing ar working in the surrounding neighborhoods and will not be detrimental or injurious to the property and improvements in the neighborhood or to the general welfare of the community based on the review of Chase factors listed in subsection C of this section". The building structure the proposed use will be part of and has received complete and approved building permits from the city of Cen#ral Point and sanitation permits from the Bear Creek Valley Sanitary Authority. These permits and inspection processes assure us that the structure will be appropriately built to protect the public health, safety and general welfare of persons residing andlar working in the area. The proposed use is a police substation. What other use could be better to promote the public health, safety and general welfare of persons residing andlor working in the area. "We plan on staffing the substation with volunteers. They will be there {3) three times a week. They would be there far approximately 4 hour periods. Our officers would use the station for "soft interviews". Soft interviews are interviews with victims vs. "Hard" interviews with suspects. We would not interview or arrest suspects at the Twin Greeks substation. On occasions an office might stop by to make phone calls ar write reports. l would think 3-4 times daily, 3-5 times a week. This information was received from Lt, Chuck Newell, Central Point police department. The proposed used would become a positive effect in the community just by having the presence of the Central paint Police Department in the neighborhood. Avery gaol deterrent to crime. The Planning Commission approved the Site Plan for the center on March 6, 2007 by Resolution 722. The center is located in the TOD-HMR, High Mix Residential zoning district and identified on the Jackson County Assessor's map as 37S 2W 03 CB, Tax Lot 7300. The proposed project area is located at 888 Twin Creeks Crossing. (Applicant: Twin Creeks Retirement, Oregon Limited Partnership; Agent: Ronald Grizxzes, Architect). CPMC 17.65.450 Zoning regulations-TOD distr•ic~ CPMC I7.6S.OS0 (C). Conditional Uses. Conditional uses in Table 1 are shown with a "C." These uses are allowed if they comply with the applicable provisions of this title. They are subject to the same application and review process as other conditional uses identified in this title. Finding: The proposed police substation on the first floor is classified as a Civic, community service use and may be permitted with a Conditional Use Permit. Conclusion: The applicant has met the procedural requirements with the filing of a Conditional Use Permit application. CPMC 17.6S.OS0, Table 3 -- TOD District and Corridor Parkifag Statadards Findings: Section 17.b5.050, Table 3 states that the number of parking spaces is to be determined as part of the conditional use review. Finding: On-street parking, designated for a police vehicle by the use of a sign and curb paint, is illustrated on the site plan. Twin Creeks Crossing, a public road, has an on- streetparking strip and is built to sufficient width standards to accommodate the police vehicles. Finding: Utilizing an-street parking will eliminate the need for off=street parking within the retirement center, thus no additional off-street spaces are required. Conclusion: The Project complies with the City's civic use parking requirements. CPMC 17.66.030 (~4). Conditional Use. Conditional uses shall be reviewed as provided in Chapter 17.76, Conditional Use Permits. When more intensive uses, such as neighborhood commercial or multifamily dwellings, are within or adjacent to existing single-family neighborhoods, care should be taken to minimize the impact of noise, lighting, and traffic on adjacent dwellings. 2. Activity or equipment areas should be strategically located to avoid disturbing adjacent residents. 3. All on-site service areas, loading zones and outdoor storage areas, waste storage, disposal facilities, transformer and utility vaults, and similar activities shall be located in an area not visible from a street or urban space. 9. Screening shall be provided for activities areas and equipment that will create noise, such as loading and vehicle areas, air conditioning units, heat pumps, exhaust fans, and garbage compactors, to avoid disturbing adjacent residents. S. Group mailboxes are limited to the number of houses on any given block of development. Only those boxes serving the units may be located on the block. Multiple units of mailboxes may be combined within a centrally located building of four walls that meets the design guidelines for materials, entrance, roof form, windows, etc. The structure must have lighting both inside and out. Findings: The proposed police substation is a 338 square foot office within an existing building. The building underwent site plan review, and was approved as submitted. Conclusion; The proposal complies. CPMC .17.67.050 (.1). Parking. Finding: A police substation is considered a Civic community services use. Finding: Section 17.65.454, Table 3 states minimum required parking as the number to be determined as part of site plan or conditional use review. The City 1'oliee Department requires on-street parking space designated for police vehicles. A condition of this approval (condition number 2} requires two (2) on-street designated parking spaces. The sign requirements in Chapter 15.24 shall govern in the T4D district and corridor; Finding: Signage specifying the on-street parking spaces are dedicated for police vehicles will be installed. Conclusion: The project can meet this criterion. CPMC 17.76.040 Conditional Use Permit: Findings and conditions. The planning commission in granting a conditional use permit shall find as follows: A. That the site for the proposed use is adequate in size and shape to accommodate the use and to meet all other development and lot requirements of the subject zoning district and all other provisions of this code; Finding: A first floor office within the Twin Creeks Retirement Center will be used for the police substation. Finding: The office space is 338 sq. ft with a restroom and is cuff cient in size for the proposed police substation activities. Conclusion: The project can rrteet this criterion. CPMC 17.76.040 (B). That the site has adequate access to a public street or highway and that the street or highway is adequate in size and condition to effectively accommodate the traffic that is expected to be generated by the proposed use; Finding: Twin Creeks Crossing is adjacent to the first floor office and is a public road adequate in width and surface to accommodate the police vehicle parking, ingress and egress. The substation will be operated by the City of Central Point Police Department. Conclusion: The proposed use is consistent with the T4D-HMR zoning and City's intent for this area.
