October 6, 1970 7:3o p.m. The common council met in regular session with Mayor Burton presiding. Ro11 call found: Almquist, Hadley, Hill, Manasco, Van Horn; present. Absent; Tonn, Zander. Discussion of the minutes of September 15. Attorney Mansfield noted that the minutes should read, ''regular session" instead of "regular adjourned session." There were no other corrections. Motion Van Horn, second Hill to approve the .minutes of September 15 as read. All in favor. Motion carried. Planning Commission minutes were discussed. Mr. Tucker explained one of the recommendations of the Planning Commission concerning the renaming of a street in West Pine Villa Subdivision. There are no homes on the portion of Rachel Drive,aWliich runs for one block westerly from the intersection of Saxbury Drive and Brad Way. In order to faciliate better mail delivery in the future, the Post Office has requested the one block be renamed. The Planning Commission has recommended the one block be named STRAIT WAY. Attorney Mansfield read proposed Ordinance No. 1003, this being an ordinance calling for a public hearing on the question of the renaming of a portion of Rachel Drive and ordering the giving of notice thereof as required by ORS 227.120 (P,~i. set for 7:30 p,m, on 10/20/70). Motion Hill, second Almquist to approve Ordinance No. 1003. Roll call vote. Al'_1 in favor. Motion carried. Ordinance No. 1003 declared duly adopted. Mayor Burton read a letter from a recent traveler to the Rogue River Valley. He was from Ontario, Calif. and noted that a picture of the sign, "Central Point Grouch", had been published in their paper. He said he knew who the Grouch was. A letter was received from Robert O. Robertson, Secretary-Treasurer of the Oregon Baseball Assoc. expressing appreciation to the city council for their continued support of the Crater Cubs Junior Baseball Team. He also congratulated A,D. Van Horn and the other coaches fo.r the great job they did on the tournmanet held at White City. K,C. Wernmark appeared before the council to question who had turned down his petition for Mayor. Attorney Mansfield told Mr. Wernmark it had been t~zmned down by Mr. Zander, City Recorder, on advice of Mr. Mansfield. . 1 ~+5 Mayor Burton told MP. Wertunark that Mr. Zander had, requested a date to be set for filing in order to have time for the petitions to be checked to.see if the signatures were legal. - Attorney Mansfield said the council may set the time for filing. Mr. Wernmark~s petition was not filed by the deadline. Mr. Wernmark then told the council he was planning to start a write-in campaige for Mayor. Petition to-get rid of the City Administrator job and to get. rid of the attorney. He also planned to petition to repeal the 15 mill continuing levy. Mayor Burton told Mr. Wernmark he had heard this be~6ore, and did not want to hear it again. ~' Mayor Burton said he was appointing Ivir. Robert Hutton; City Clerk, Santa Barbara,. Calif. as the new administrator effective November 1. ~ He asked the council to approve his appointment. He felt that the ~ committee had done a thorough job of screening applicants and felt ~'~ the decision to appoint Mr. Hutton was the right decision. Mr. Wernmark questioned the Mayor as to the salary Mr. Hutton would receive, and was he to have a one year contract or three year contract or what . Mayor Burton informed Mr-. Wernmark that the council had done their work and did not have to answer any more questions. Attorney Mansfield advised that a citizen has the right to ask these questions of 'the Mayor and council. Councilman Manasco told Mr. Wernmark that the salary would be ~8G0 per month. The administrator was appointed by the.Mayor to be approved by the council. -The council could also discharge the administrator.: Mr. Hutton was chosen from approximately 60 applicants. Motion Manasco, second Almquist to approve the appointment of Robert Hutton. as City ;Administrator, effective November 1, 1970.. Roll call vote. All in favor. Motion carried. 1 Attorney Mansfield then read Resolution No. 157, this being a resolution ordering a biennial election for city elective officers on November 3, 1970. Motion,Manasco,:second Almquist to approve Resolution No. 157. Roil call vote. All in favor. PIotion carried. Resolution No. 157 declared duly .adopt ed. Attorney ;Mansfield then explained proposed Ordinance No. 1004, this being an ordinance relating to numbering of residences-amedding ordinance no. 290, Code of Central Point, 1967, 10-1. The prime changes in the ordinance would be to change the title, Street Commissioner to City.Administrator for the purpose of the ordinance. Vern Capps, street commissioner, was asked i.f he objected to the ordinance being amended to specif~Z the City Administrator in the ordinance. He said he``had ono objections. ~:~ Attorney Mansfield reported on a meeting he had. with Supt. of Shcools, Mr. Meyer and the Chief of Police, Jack Sanders. They had met to discuss what could be done about interlopers-past school age-causing traffic problems and other problems on the school property. He said they felt the trespassing ordinance should be amended to be more specific about anyone coming into the school grounds without permission. He would prepare an ordinance for the next meeting. Purpose - to have authority in Municipal Court as well as District Court for such cases. Chief Sanders said he hart very good cooperation from Mr. Meyer on the matter. Mayor Burton expressed his pleasure in the actions of the Fire Department and. the Police Department during the fire at Cheney~s mill and other areas. Both departments dial real fine jobs and are to be commended. Mr. Tucker said there were some items needed for the council room. He asked if the counca.l wanted a clock. Mayor Burton said he would provide one if Mr. Hill or Mr. Manasco would pick it out. A7r. Tucker advised the council and mayor on the League of Oregon Cities meeting to be held. November 8-~-10 at Portland. Room reservations are to be made by October 26. He had Sanders, Higinbotham, Tate and the Recorder planning to attend. He thought Mr. Hutton would want to attend and. possibly Mr. Hamer too. He asked the councilmen to let him know if they were planning to attend. Councilman Manasco mentioned. the proposed new Oregon Municipal Policy as something the council should be interested in for study, prior to attending the League meeting. Council meeting of November 3 falls on election day, and another day will be set for the meeting. Councilman Hill questioned the City Administrator's report on the alley behind the new U.5. National Bank. Mr. Tucker said the engineer and the bank had not held to their bargain on paving the alley. City Engineer had advised them that he would not accept the alley as it was. Councilman Manasco reported. on RUCG. They have been without financ e officer, but have appointed Bill Olson. The finance officer would handle grants when they come through and process government applications. In the recent voting on the Rogue River sewage treatmmnit issue, Mr. Manasco said he abstained from voting, because he~felt the work on the engineering had been done too long ago. He said application. has been made for $10,000.00 fora program, called the Lockheed program, to have 20 classes of about 1 hour each for the Seventh grade students on the problem of drugs. This would amount to approximately $1.30 per student. The council ~jad appointed Manasco, Schroeder and another member of the council to work with the Law Enforcement Committee to study the need for a coordinator. He reported that the crime ~g@e in the State was up g~, but in Jackson County it was up 21~. Law Enforcement grants would be $110,000..00 this year as compared to about $55,000.00 last year. r' =~' Councilman Manasco also reported on a meeting of the Sewer Committee= Almquist,,Capps, Manasco, regarding the maintenance of sewer lines-from, the property line to the main line. If the city. took. over, this job, it would mean increased work .load,.-costs for overtime-and additional costs for materials in the budget. Most of the calls would probably be at night or on the week-ends. The committee felt it should be stupulated that the city would not work on any private lines,. if they went to this kind of maintenance. Mr. Manasco said Vern Capps, Public Works Supt., did not agree with this plan of having the city maintain the lines from the property line to the main trunk. He said he had.too much other work to do on~,storm drains, and other projects. He peEferred to leave it as is. Councilman Manasco listed three items that should be set out in the ~ ordinance if passed." 1. no charge to be made if the work is done ~ during working hours. 2. if there is no clean-out must be installed ~ at the property owners expense. 3. charge overtime for after hours ~ work. Councilman Hill agreed with Mr. Manasco. Give the property owners a list of the stipulations, then if they want to have the city proceed with the work, they will have to abide by the stipulations. He felt the city should make up some stipulations and try it. (City Adm., Manasco, Capps and attorney to draw up proposed stipulations.) councilman Hill brought to the attention of the council that Election Day would-not be a holiday effective January 1971. He thought the city should consider giving the employees another day in lieu of Election Day, possibly Washington's birthday as some other businesses have, or the employees birthday. The; council instructed Mr. Tucker to poll the employees to see which they would prefer, Washington's birthday or the employee's birthday. Councilman Manasco said it had been brought to his attention that an employee leaving the city did not receive any accrued vacation. He asked if the council should consider pro-rating the vacation for the employee upon leaving. 1 Councilman Van Horn noted that i.f you quit, you lost any vacation if you are in a union. After further discussion, the matter was referred to the Administrative Committee. Discussion on Franchise Tax from Cable TV. Fire Chief Higinbotham was questioned about the recent fires and if he had all equipment back in service. He reported he had. Councilman Manasco questioned if the Fire Dept. could carry any barricades on the fire trucks to block streets at a fire. Mr. Higinbotham said they discussed ity but had very little room for them. .:Police Chief Sanders said the department might be able to carry some in the back of the police cars for emergencies. 7 Chief Sanders suggested that letters be sent by the Mayor to the various departments that assisted in the recent fire at Cheney~s and other areas. Oregon State Police, Medford Police and Jackson County Sheriff Dept. Fire Chief Higinbotham said assistance had been received. from the Medford, ,Talent, Ashland and Jacksonville Fire Departments. Mayor Burton asked that letters be written and he would sign them. Motion Van Horn, second Hadley to approve the paying, of the bills. All in favor. Motion carried. There being no further business, a motion was made. by Manasco, second Hadley to adjourn the meeting to the next regular meeting or the call of the mayor. Motion carried.
