Roll call found present: Almquist, Hadley; Hamer, Lance,_Manasco and Van Horn. Absent: none. Also present:~Mansfield, Hutton, Tate. Absent:-Recorder 7,a.nder due to illness. Minutes°of the meeting of January 19, 1971 were discussed. Motion made by~Hadley, second Almqua.st to approve the minutes of the January 19th meeting as written. All in favor. Motion carried. Noel Moore, representing the Central Point Little League,asked the council if they could use some of the city equipment to prepare a new park on Hanley Road. Equipment requested was welder-and grader and city employees would operate them. He said city employees had already volunteered their services. Approximate time would be one week-end, They would have insurance that would cover anything on the field. Motion made by Marasco, second by Van Horn to allow them to use~the city equipment as requested, provided it was operated by city employees. All in favor. Motion carried. Paul Emery, 57g N. bth St., questioned if building construction on homes was inspected by the city. He said he had a house that was only 8 years old and the bath room floor was rotted out. Particle board had been used in the floor. He felt this type of flooring should '" not be used where it would draw moisture. i,Y'ouncil referred it to the building inspector and will report back.to-next meeting.) ~,loyd Albern, 900 'omet Ave., asked what had been done about-the dog kennels on .:omet l;ve. Attorney Mansfield-gave a report on what had happened to date. He had discussed the matter with Mrs. Steve Elko and they had agreed that Wooten's sha~ld have reasonable time to correct the problem.. If after that given time the problems are not corrected, then he would prepare a complaint if someone would sign it. Councilman Van Horn said he understood, according to Mr. Albern, that no action had been taken. Mr. Mansfield said Mrs. Elko was to report any unreasonable odor, etc. to him. Mrs, Elko told the oouncil she had called Mr. Mansfield's office twice but he had not returned her calls. But Mr. Mansfield was correct in saying that she had agreed to give the Wooten's sufficient time to correct the problems. ~: :J-. `~Ir. Moore said that since this complaint the city sweeper .has been.. too the subdivision to ..sweep. City employees :have .stated that the: st eets•were no worse than others in the city. - Mr. R hfeldt, 212 Kings Way, said he had lived in Central Point s' ce 1964 a no sweeper had.been-on his street in 6 years. Mr. Mansfield said he intended to go ahead and prepare the complaint if someone was willing to sign it. He said he•understood that Mrs. Elko was the spokesman for the group, and that she would report any unreasonable odor or noise to hime and then a complaint would be prepared. Mrs. Elko said she would not sign the complaint, but after further discussion, said that she would. Other citizens present also siad they would sign the complaint if necessary., Mayor Offutt then asked Mrs: Elko if she would 'sign the complaint when Mr. Mansfield had it prepared. She stated that she would. She was instructed to remain after•the meeting, or meet with Mr. Mansfield at her convenience and he would .get the information needed. Noel Moore, W._L. Moore Construction Company, told the council he understood that there had been complaints against his company about leaving debris on the streets in the West Pine Villa subdivision.' He asked Councilman Van Horn what he found_ on the streets that caused the complaint.. Councilman Van Horn said he had inspected the streets and found mud on the streets, cars parked the wrong way, .and complaints hdd been received about flat tires caused by nails left in the streets. He said this debris needed to be taken care of. Noel Moore told the council that he has his workers clean-up the streets with shovels after work each day, and after trucks have . ., made deliveries. His workers have not haci any flat tires ,to his knowledge, and he questioned the possibiiity~of picking up a nail in the tires from a paved street. He said if anyone had a flat tire from a nail picked up in the area of his construction, he would reimburse them for any flats now or in the future. ~ ° Councilman Van Horn told Mr. Moore that rocks had fallen from trucks making deliveries and been left in the street. Mr. Moore answered• that this happened in most of the streets in Central .Point. He could not prevent this from happening, but he tried to clean-up anything in the area of his constr'tnet~an. If Councilman Van Horn would check, he would .find that many streets in Central Point are dirtier than the ones in the subdivision. He-felt that his company had done more than any other contractor to keep their area clean. Councilman Lance asked Mr. Moore if he felt they,had done all they could to keep.the construction area clean. Mr. Moore stated that they had done more than any other contractor he ,knew of in.the area. Chief Sanders said that 75% improvement has been made since a warning was given. He siad he also lives in the subdivision. Councilman Manasco said he 'had asked Mr. Moore to come to the council° and explained his side of the situation. Mr. Manasco said he felt the Moore Construction Company had .done their share of keeping the streets clean. 3 ~` Mr. Moore -said that since this complaint, the city sweeper has been to the subdivision to sweep. City employees have stated that the streets were no worse than others in the city. The bonding attorney~:agrees to pay the cost of the publication, since they made the mistake in approving the sale of bonds as prepared. Mr. Mansfield said the banks would probably bid the same. He asked the council and mayor if they would meet in special adjourned session on Friday, February 19, 1971 at 5:00 p.m. for the bid opening. Mr. Mansfield was questioned as to the cost to the city because of this error. Mr. Mansfield said he had liability carrier to cover any mistakes if caused by him. But Mr. Rankin, bonding attorney, said that these errors happen sometimes, even though careful preparatiob is made.- . Administrator Hutton asked Mr. Mansfield if this would be bid opening and award? Mr. Mansfield said it would. Mr. Mansfield then read and exp~.ained Ordinance No. 1012, relating to the bond issue. Ordinance No. 1012, an ordinance relating to the issuance of City of Central Point General Obligation Fire Truck bonds in the amount of $t.~2,000.00; providing for the form of said bonds and maturities thereof; directing publication of a`call for bids thereon; and declaring 'an .emergency. Motion was made by Manasco, second Almquist to approve Ordinance No. 1012. Roll call vote. All in favor. Motion carried. Ordinance No. 1012 declared duly adopted. Administrator Hutton questioned Mr. Mansfield if these-were the only - bonding attorneys available to the cities, since it seemed it worked a hardship to only have the one available. He asked the council if they would consider extending to a San Francisco or Washington market. ~_~# Attorney Mansfield answered they are the only bonding attorneys in Oregon that money houses will approve. They are a conservative firm. Attorney Mansfield then explained and read Ordinance No. 1013, this being an ordinance relating to sewer line maintenance, and amdnding Ordinance No. 303, Code of Central Point 9-2, sec. 3. Motion was made by Van Horn, second Hamer to approve Ordinance No. 1013. Roll call vote. All in favor; Motion carried. Ordinance No.- 1013 declared duly adopted: Administrator Hutton brought to the attention of the council a proposed resolution to apply to the State Highway Department for funds for repair to Pine Street from Front Street (Hw 99) to 9th Street. If adopted, the city would have to abide by the State requirements. The funds are for small cities. :_The city may apply every two years for $25,000.00. The State determines which city receives the money, after the resolution is adopted and the project checked. After lengthy discussion, the matter was referred to the City Adm. to obtain more information on engineering, right-of-way, etc. and who would pay for them. Administrator Hutton asked the council if they would like to appoint someone to the-Rogue Basin Flood Control and Water Resources Board. In the past Donald E. Faber as representative for the city. -And Mr. Faber would be willing to continue in-this position. The council appointed Donald E. Faber as representative to the Board with councilman Manasco as alternate. Councilman Van Horn, Park and Recreation committee, reported on a bill proposed by Rep: Stathos, which would increase cigarette tax 2¢. With the money to be used only for parks and recreation. Mr.. Van Horn urged support of this bill. He said 2~ would be used for administration costs and the balance would be 50~ to the counties and 50% to the cities. Councilman Manasco, water committee, asked for a preliminary meeting at his home on February 4 at 7:30 p.m. to discuss water rates. And a meeting with Bob Lee, Medford Water Commission on February 9, subject to-the approval of Mr. Lee. =The meeting with Mr. Lee to be with full council. - Administrator Hutton reported that the tape of the previous meeting ~- with Mr. Lee was not very good. Too much background interference. In order to have a good tape, it would require only one speaker at a time. Councilman Manasco reported on the Rogue Valley Council of Governments . meeting. Two applications were presented for approval. 1. Lake of Woods Highway alignment. (tabled) 2: Wagner Gap Road construction. (tabled) Also, notice of a meeting :to be-held in Salem on February 8. 1 Administrator Hutton asked the council if he should attend an Inter-City Manager meeting in Bend on March 12 and 13. Councilman Manasco asked if the money was available in the school and meetings ' budget. If so, he would recommend Mr. Hutton attend in the interest of the city. " Mr. Hutton said he had provided a copy of the Newsletter for each of the councilman, so that they could keep up on the legislation as"proposed. 1 Councilman Manasco also reported that the Rogue Valley Council of Governments is going to study all legislation pertaining to cities. Bills were presented for approval. Councilman Manasco questioned the bill from Meza Electric for the shop building. The bid was for $519.00, but the bill was for $560.60. Mr. .Hutton explained that a different type .of compressor was .necessary than was in the bid. The. additional cost was for 9_t. Mr. Manasco said he did not..question the bid, he felt it ,was an excellent bid. But he did question the need for-the different compressor. After discussion, Mr. Manasc o said he would approve the bill for payment if the work was completed and .Vern Capps, Public Works Supt., was satisfied with the job. Motion was made by Hamer, second Almquist to pay the bills. Motion carried..' There being no further business, a motion was made by Hadley, second Hamer to .,adjourn to the next regular meeting or the call of the Mayor.. Motion carried.
