Present: Mayor Manasco, Councilmembers Almquist, Hadley, Hamer and Tally. Absent: Councilmember Rowe, and unfilled vacancy. , Other Present:. City Treasurer Tate, City Administrator Hutton,. Police Chief ~Sander.s, Fire Chief Higinbotham, Public Works Superintendent Capps, and Building Inspector Chastain. U.thers Absent: City Recorder Zander. The Minutes of the Regular Meeting of the City Council held October 26, 1971 ,were approved on motion by Hamer, seconded by Almquist and unanimous, affirma- tive vote of Counc-ilmembers present. The Oath of Office for Mayor Manasco was announced as having been administered ,,by..City Recorder Zander at 4:45 P.M. on Thursday, November 4, 1971. -The appointment of a councilman to fill the vacancy in Ward,.4.was continued`to the Regular Meeting to be held on December 14th, 1971.. by .unanimous consent of the• Council... ~ - The election~of~a Chairman of the Council was the next consideration. Council- members Almquist, Rowe and Hamer were nominated. The City Attorney tallied the votes and~announce.d~that one nominee had received a plurality but, not .a majority _ and the other two_ had received identical votes., Due to the absence of Council- man Rowe and the unfilled vacancy, it was agreed by the. Council that another effort be made to elect the Chairman at the December 14, 19.71 Mee ing of .,the„ . Council. Mayor Manasco announced receipt of a notice of a meeting on Water Cross Connee- tion to be held in-the Medford City Hall at 7:30 P.M. on Tuesday November 16`, - 197.1..` Public Works. Supt. Capps or one of his staff will attend. The request of Councilman Tally for repairs to North Central Valley Drive was reported~on by~the City Administrator showing an estimate of $3,AOO.UO ao recap `.66.0 lineal feet of ;36 foot paving but pointing out the deficiency of the curbs which should be .replaced before street. repair - and this would cost approx- mately X2,500.00 additionally. It was recommended by the Administrator, .that this .should be considered a property-owners cost and could be financed by the`, Bancroft Act. Messrs.. L. Hoback, Jim McBee., Kerry Lay and Mrs. Tom~Malot, all ,residents on the street in question, presented themselves stating their individ- Dual vie'ws~to the effect that the street shouldn't be repaired until the .curbs ` were. repaired and that the curb cost shouldn't be charged to the property-owners since: apparently the City. had accepted inferior work .and. material some seven years ago-when the Subdivision was accepted. Some concern was shown that any '~ great amounts of money should be expended on this street; as the type and amount of street base was a question, also. All aspects of the street condition and proposed repair were thoroughly discussed and each who cared were given the chance to present their views. No decision was reached by °:- the Council and the matter was continued to allow Councilman Tally to ex- plore the possibilities with the property-owners and consider the costs involved. Mr. Earl Kelley next appeared before the City Council to inquire.of any steps that could be taken or any progress that had been exper_3eneed in acquiring a°separate mail ZIP code for the City., The Mayor reviewed past efforts made on behalf of the Gity to this~end and indicated an effort would be made to see what additional steps could be taken at this time to acquire this number. It was pointed out that the name or number of nearly every street in Central Point was duplicated in the City of Medford and this fact seriously hampers the timely mail distribution. Mr. Edward Bassett once again presented the problem of residential construction without provision for sanitary facilities for the workers. He stated that this was objectionablhe to neighboring houses which were occupied. Upon re- consideration of this subject previously presented by the citizen, the City Council instructed the City Attorney to provide the necessary amendatory ordi- nance for its consideration. 'Mayor Manasco announced that funds were available through. the Rogue Valley Council of Governments, Jackson County and Federal programs for the 701 Planning grants and-there, were few requests for these funds from eligible agencies. He explained that if the City approved the application for these funds and it was approved,`certain benefits could accrue to the City; namely, to update and expand the General Land, Use Plan to a point where it can be adopted, plan for fringe areas to the City to outline. future growth and con- trol of development,, and to provide factual information for consideration of ,.zoning ordinance revision. Upon motion by Hadley, seconded by Almquist, authority was granted Mayor Manasco to prepare an application for a grant of 701 Planning Fonds in the amount of ~8,000.OU for the City of Central Point. An Ordinance amending~Ordinance No. 1022 "An Ordinance initiating the street proceedings for real property therein described, setting a.time and date for public hearing to be held on the question of_said vacation, and providing for the giving of notice as required by ORS:Chaper 271" was presented which would add Lot 15 of Block 2, Oak Park Addtion~to those lots mentioned in the original ordinance and erroneously omitted therefrom. On moti"on by Almquist, seconded by Hadley, Ordinance No. 10221 as revised, was adopted by unanimous affirmative . vote of Councilmembers present. An .Ordinance amending Ordinance No. 1026 "An Ordinance vacating a certain pub"lic street and alley, as described herein" was next presented which also included the additional of Lot 15, Block 2 of the Oak Park Addition which also had been erroneous y omitted from the original version<`of the ordinance was adopted. Upon motion by Almquist, seconded by Hadley and unanimous votes of all councilmen present, Ordinance #1026 (revised) ivas adopted.. w ~, '_. • kt~ ~'-' City.Attorney Mansfield presented an ordinance for_ Council, consideration • which would initiate proceedings and set, December 14, 1971 as a date ,of • public hearing on the.. matter of the withdrawal of the Elmore annexation from;the Bear Creek ValleyxSanitary Authority and ahe Central Point Rural Fire Protection Di trict.. On motion by Hadley, seconded, by Almquist, City Ordinance No. 102as adopted by a unanimous vote of Councilmen present. The City Administrator presented application for renewal of liquor licenses from the-following: _.- ~Riehard's,Food.Centers, Inc_. dba Pay and Save Market ~~C..R. Arndt, dba The Corner Clnb ~"'` ~ ~ Dale and, Evelyn Van Wey, .dba Van Wey's Market. ~ ' Motion by Hamer, seconded by Tally and affirmative vote•of Councilmen . ~~, 'present, the~four applications were approved. ~? The City Administrator then presented the application of Mayor Manasco for a'variance to permit the construction of a 6-foot fence along Mazama Street, ..approximately 12 feet inside the curb line instead of the 32 foot height .authorized by code. After a thorough discussion of the application and. the . variance procedure as authorized by the City code and the description by ,.Mayor Marasco that this was repairing or replacing an existing fence which was constructed prior to the aoioption of the fence ordinance anoi would not obstruct.v;eion at. the street intersection, the variance was approved.on motion by Hadley, seconded by Almquist and a unanimous affirmative vote.of ~the.Councilmembers..present. •i The City •Administrator•then presented the situation at-the site-of construe- tio)n of'.2•oiuplexes at 253 and 255 North First Street; Doug Pickell, contractor and owner. These are-concrete block buildings being constructed in City Fire Zone l and either. through ignorance of requirements or oversight,• flexible plastic wiring had ..been installed instead of conduit or thin-wall (flexible metal cable~~. This violation was noted by Mr. Brooks, State Electrical .Inspector., and construction was halted. Mr. Pickell had requesteoi relief through-ahe City ..Administrator through ,a,waiver or variance which would. allow hm:to,proceed. -The Ciay Attorney advised the Council that they. did ,not have the legal authority to ..grant a waiver or variance in this matter. ,After thorough;dscussion of the matter, .the City Council, by common consent,..,., determined that the contractor must comply with-the restrictions before pro- ceedng, and was not interested in considering amending the ordinance to -allow.for•a variance procedure. The Council concluded the matter by refusing to takeaction on Mr. Pickell's request as related by the City Administrator. The ;City Attorney presented an ordinance for Council consideration"Relating to trespass and loitering in school buildings or. on school grounds and amending Ordinance No. .306". This proposed ordinance was discussed by.the~ City Attorney and indicated that it had a reserved approval by the .,Gity:Police ' Chief. and had been the result of various meetings with school officials. It was suggested that if the Council wished time to review the progisions and consequences, the matter of adoption could be postponed to a later meeting as ..y. { d ~ ~ .. .. ~~ ~'' (1 e~:_c~ it was agreed that .no dire emergency existed which would require its immediate adoption.' By common consent of the City Council, the consider- ation for adoption of this Ordinance was delayed until the Regular Meeti+ng of the City Council to be held December 14, 1971. Mayor Manasco then announced that it would be his desire that only ordinances ordered prepared by the Council or emergency ordinances should be considered for adoption on"the day presented, and all others should be accepted-for study only; and consideration for adoption at.a later date. The City Attorney next presented an Ordinance "Relating .to the. Building Code and amending Ordinance No. 853". It was explained that this removed the objection of having to first get a permit before doing`roiitine mainten- ance on~dwellings and other buildings. There appeared to be some ambiguity to the ordinance as permits .for maintenance work was required in one section., but in another section of the ordinance they were not required. This amenda- tory ordinance would require a'permit only in the case of involving'structural changes and structural additions. Ordinance No. 1030 was adopted.on motion by Hamer, seconded by Tally and unanimous affirmative vote of Councilmembers present. The City .Attorney next presented an Ordinance '!Relating to Trains and amending _ Ordinance No. 108". It was explained that .this ordinance provides for a fine of not less than $5.00 or more than $200.00 and imprisonment of not less than 1 nor more than 30 days, or both, upon conviction of blocking any City streets with trains .for a period greater°than 5 minutes. The former provisions.in- cluded fines of $5.00 to $20.00 and imprisonment of 1 day to 10 days or both. This Ordinance was prepared at the direction of the Council in an effort to relieve-past infractions. Ordinance No. 1031 was adopted on motion by Hadley,..seconded by Tally and unanimous affirmative vote of Councilmembers present. The .City .Attorney explained the case of State of Oregon (Department of Environ- mental Quality" versus The City of Central Point.. This case relates to the City dumping raw `sewage into .Bear Creek., The full legal implications of all the. legal aspects were discussed and 'the City Attorney .requested authority from he ,City Council to proceed to enter a stipulation .for consent decree. The case originally scheduled for Court on November 8, 1971 had baan~;:continued . to November,l5, 1971 and could be extended further if necessary to allow proper officials to appear who would be in Portland attending the annual conference o~f The League of Oregon Cities,+ Mayor Manasco then inquired of progress by the City .Planning Commission on the formation of a policy on the removal of trees in the street-right-of-way. He was advised that the Planning Commission had not yet had an opportunity to meet on this subject since the .matter had been referred by the Council. A report from the City Administrator on a.proposal for gasoline storage facilities was not available for presentation at this time.- 1 ~~, ~3 -}.~pr r/o:1 l The Mayor announced the following committees of the City Council: Administrative Committee: D. Upon motion by Hamer, seconded by Hadley, the bills as presented for payment Gist attached were ordered paid upon the unanimous affirmative vote of the Councilmembers present. There being no further business to come before the Council, the meeting was adjourned at 10:37 P.M. upon a motion by Hamer and seconded by Almquist and a unanimous affirmative vote of Councilmembers preaent.
