City Hall Council Chambers

September 12, 1972
The Common Council met in regular session at 7:30 P.M., Mayor Robert Manasco
presiding. Roll call found the following councilmen present: Hadley, Hamer,
Mills, Russell and Tally. Absent being Councilman L.L.•Rowe. Also present
were City Attorney Mansfield, City Administrator Hutton, Recorder Zander, City
Treasurer Tate,-Police Chief Sanders and a near capacity attendance of citi-
zens.
The Mayor referred to the reading of Council meeting minutes of August 8th
and the 22nd for approval or corrections. Motion was made by Hamer, seconded
by Russell to accept the minutes of both dates, August 8 and August 22, 1972
as read. With all in favor, motion was carried.
At this time Mayor Manasco advised that the scheduled public hearing on Zone
change be held as requested by James Anhorn, of Freeman Road, property owner.
The Mayor advised that the zone change would include three parcels of property,
i.e., Anhorn, Lamb, and Kincaid; located on Freeman Road and portions joining
I-5 Freeway. He further stated that the desire of the petitioners is for
changing it from the R-1 to the C-4 Zone, for commercial use. Mr. Mansfield
referred to the Zoning Ordinance and read the uses and conditional uses. On
questions from the floor, Mrs. L. Lamb was recognized by the Chair. Mrs.
Lamb wanted to know if her tax structure would change if zoned commercial.
Mr. Hutton advised that the County Tax Department would be the only one to
answer the question correctly,.: However, it could have some increase in land
value as from its present use. Mr. Robert Kincaid spoke as a propertyowner
in question and did not favor the zone change at this time, but would go along
with a commercial zone when the need or interest would warrant it. By no
further questions from the floor the public hearing was ordered closed. Council
discussion held. Councilman Tally advised that the City is undergoing a "future
planning study" and should be near completion some time early 1973, and recom-
mends a continuance until the study has been made. With no further discussion,
motion was made by Tally, seconded by Hadley to deny the zone change request
for lack of endorsement, or until the planning study has been presented. Roll
call vote, all in favor motion carried.
Mayor Manasco opened this portion of the meeting as a public hearing on with-
drawing certain property from the Bear Creek Valley Sanitary Authority and
from the Central Point Rural Fire Protection District. The Mayor also announced
that these three parcels of land are known as the Anhorn, Lamb-and Kincaid
properties. On comments from the floor Mr. Robert Kincaid stated "I'm all for
this". No objections were raised for the withdrawing, and the public hearing
was declared closed. Council discussion held. Attorney Mansfield read the
proposed ordinance and reading in part: "An Ordinance Withdrawing Real
Property Described Therein from the Bear Creek Valley Sanitary Authority and
the Central Point Rural Fire Protection District". By Council action, motion
was made by Mills, seconded by Russell to adopt the Ordinance as read. Roll
call vote: Hamer no, Hadley no, Mills yes, Russell yes, and Tally yes. By
majority vote in favor, Motion was carried. Ordinance #1066 Declared Duly
Adopted.

Mayor Manasco called for the scheduled public hearing as advertised on certain
property for annexation and known as Moore Park Addition. The Mayor described
the property in location and the petitioners being W.L. Moore, General Contractor.
The Mayor called for any questions or comments from the audience; none noted,
and the public hearing was declared closed. Council discussion held. Attorney
Mansfield reading the proposed ordinance and reading in part: "An Ordinance
Annexing a Contiguous Area to the City of Central Point, Oregon". Motion made
by Hamer, seconded by Hadley to adopt the Ordinance as read. Roll call vote.
All in favor motion carried. Ordinance #1067 Declared Duly Adopted.
The Mayor referred next to the Agenda item of liquor sales license renewals.
~ The license to be considered for renewal are known as The Corner Club and the
4--i Central Point Grocery. The Mayor called for any voice of objection from the
CC: attending public and from the City Police Department. By no objection, motion
~+ was made by Hadley, seconded by Russell to acknowledge the renewal requests.
All in favor motion carried.
Mayor Manasco read-the peition of Dr. and Mrs. Paul T. Rutter requesting annex-
ation to the City of approximately 14 acres located near Hopkins and Bursell
Roads. The petition request includes an R-3 Zone with Conditional Use for a
mobile home park. Discussion held. It was the Council's recommendation that
the annexation with zoning be presented to the Planning Commission for their
study and decision.
Mayor Manasco referred to the proposed ordinance relating to site plan and
landscaping approval and construction plan approval. Discussion held. Planning
Commissionmember Cal Bowers complimented the City Attorney Mansfield for the
reconstruction of a document and coming about with a very good looking piece of
legislation. Mr. Mansfield stated that this compliment is very unusual from
Mr. Bowers= "A man with a critic's mind at work at 'all times!", and thanked Mr.
Bowers for his feelings. After the intensive discussion, Attorney Mansfield
read the proposed ordinance and reading in part: "An;Ordinance Relating to Site
Phan and Landscaping Approval and Construction Plan Approval, and Relating to
the Zoning Ordinance of the City of Central Point, and Amending Ordinance
No. 893, As Amended, and Providing Penalties and Declaring an Emergency". With
no further questions, a motion was made by Tally, seconded by Russell to adopt
the ordinance as read, and declaring the emergency clause to be part of the
.Ordinance. By Roll call vote - all in favor. Motion carried. Ordinance #1068
Declared Duly Adopted. `
The Mayor next referred to the proposed ordinance relating to subdivision approval
and: amending Ordinance No. 723. Discussion held. With no question raised,
Attorney Mansfield-read the proposed Ordinance and reading in part: "An Ordinance
Relating to /Subdivision Approval and Amending Ordinance No. 723 as The Same is
Amended by Ordinance No. 1050". Motion made by Russell, seconded by Mills to
adopt the Ordinance as read. Roll call vote. All in favor motion carried.
Ordinance #1069 Declared Duly Adopted.
Mayor Manasco called for Council's opinion and study of a proposed ordinance
relatng'to regulations of permissable and restrictions on "trees" on public
streets, and other public places. Discussion held by the Council as well as
involvement of numerous interested citizens in the audience. Attorney Mansfield
presented the proposed ordinance and reading in part: "An Ordinance Regulating

the Planting, Maintenance, Protection, Control, and Removal of Trees In and
Upon the Public Streets aad Other Public Places in the .City of Central Point
and Providing a Penalty for Violation Thereof and Repealling all Ordinances
in Conflict TYerewith". Motion made by Hadley, seconded by Mills to adopt
the Ordinance as read. Roll call vote. All in favor, motion carried.
Ordinance.#1070 Declared Duly Adopted.
The Mayor read the proposed ordinance relating_to Weed Abatement. After a
thorough discussion of the ,proposed ordinance Attorney Mansfield presented
the proposed ordinance and reading in part: "An Ordinance Relating to Weed
Abatement and Providing for the Assessment. of Weed Abatement as a Lien
Against Properties, Subject to Foreclosure in the Manner Prescribed for
Special Assessment Liens, and Providing Penalties". Motion was made by
Russell, seconded by Mills to adopt the Ordinance as presented. Roll Call
vote. All in favor motion carried. Ordinance.#1071 Declared Duly Adopted.
Mayor Manasco referred to the proposed ordinance declaring the Council's
intent to cause construction of curbs, gutters and paving of Mazama Street.
Mr. Hutton spoke of the petitioner's of signatures as being a f avorable per-
centage for the construction of Mazama Street improvements. He also advised
that a large portion of Mazama Street as already having straight curbs and
gutters. He suggested that the City should consider uniformity of construction
by having both sides of Mazama Street with gutters. Discussion held. Attorney
Mansfield read the proposed ordinance and reading in part: "An Ordinance
Declaring the Council's Intent to Cause the Construction of Curbs, Gutters,
and Paving on Mazama Street from Third Street to Sixth Street". With no
further discussion on the issue, motion was made by Hamer, seconded by
Tally to adopt the proposed Ordinance as presented. Roll ,call .vote. All
in favor motion carried. Ordinance #1072~Declared Duly Adopted.
In Written and Oral Communications the Mayor advised that no correspondence
is noted and asked for any oral discussion of general interest. Councilman
Tally mentioned that after .several months of delay on the repairing of North
Central Valley Drive he again was reminding the City Administration of the
existing condition. Mr. Hutton advised that a lack of interest was noted by
petitioning for curbs and gutters of propertyowners. Mr. Hutton also stated
that he would pursue the repairing of the existing street by placing a cap
overlay.''
By numerous complaints of excessive smoke in the Councilroom during meetings,
it was suggested that Mr. Hutton "post the area"„to such contaminators
causing air pollution; i.e., "No Smoking".
Mayor Manasco advised that the next 701 Planning Meeting will be held on
September 28th in the effort of securing additional background data.
The Mayor referred to a letter he received from Mrs. Jana Harested, City
Planning, requesting a salary adjustment. The Mayor advised that all Council-
men secure a copy of this letter and give the request consideration and report
at the next Council Meeting.

The Mayor requested that the City Recorder report of candidates for City
Elections. Recorder Zander read the names of fourteen citizens and their
petitioned offices.
Mr. Hutton advised of receipt of a letter to the City claiming damage to a
well of Carlton G. DeMott was read. Mr. Hutton stated that the rock blasting
at the granite pit appears to be the problem. Attorney Mansfield referred to
the insurance policy as being sufficient carried by Mr. Robert Lull, leasee.
Mr. Hutton advised of an advanced Central Dispatching System through the
Medford Fire Department and recommends Council attention to the matter.
Mr. Hutton advised of a City Capitol Caucus Dinner Meeting at the Red Lion
Restaurant on September 25th at 6:00 P.M. for hearing State candidates and
their view on Cities of Oregon. The Mayor and Council recommended that Mr.
Hutton extend invitations to our City candidates for attending this meeting.
The notice of the Annual League of Oregon Cities Meeting was read by Mr.
Hutton as scheduled for November 12 through 14th in Portland.
Mr. Hutton advised that the 90-day trial period of Slurry Seal has passed
and the Council should consider disposition of the unpaid account. Mayor
Manasco requests the City Engineer's report and recommendation before any
decision be made. The report is requested for the September 26th meeting.
The bills were presented before the Mayor and Council for study and .payment
approval.
Motion was made by Russell, seconded by Tally to. approve the bills for
payment as presented. With an all in favor motion, carried.
With no further business to come before the Council, a motion was made by
Hamer, seconded by Hadley to adjourn to the next regular meeting or to the
call of the Mayor. With all in favor, motion was carried.
