Pairs. harshall stated they would like to-make•a request that the street improvement should end at Cherry Street `.anstead•.of tl~;North end of First Street,-since it was a dead end. Accardrig to -:the plans, the carport and some trees belonging to the Grgsby~s would have to be removed. Also, the Grigsby's are not now on the sewer line, and Mrs. P~tarshall felt they would not be able to `,connect~~to,"the .new line, due to the location of a well.between the house. and where the sewer line would come out to the street:, Also, thectdrain line for.stomr run-off would cause the water to back up into the ' Grigsby-.property: ~~Mr; B, .Warren, City engineer, advised Mrs. Marshall that the new sewer - "line would help the Grigsby fir-op~rty, and. a strom drain wou d carry qff "'the run-off water. The ('=rigsby~s would be able to connect to the sewer ` lane, and could install a cast .iron lane through the area where the well is locat.ed.',Since the well is for irrigation only. ~~~.:,~ ~G ~x~ ~`s~~ i~ ~~ \ F' ~~~ ,. Ki;ght was ads~~sed that if the contractor could not ftaish the blacktop in the reasonable time as allowed., the Kights wou~.d have to write a letter to the cou.nc.il requesting additional extension of time. -Fi.rial .approval will be given ,when the covenant is signed and black top finished and all agreements complied with. The blacktop specifications would have to be 3" crushed. rock and 2!' black top. (asphalt) or L~!' concrete. The., plan as agreed upon was submitted. to the Kights for their signatures of approval and acceptance. 't'hey signed, ~ •Mr. T~ushaney said_he ~rould ask to have the Kights release Mr, Gilham ~_ and. any. other city officers or officials from any law suit, Ifrs, Kight CdJ ~ said the filing had. not been a suit against Mr. CTi_lham, i_t was a , mandamug proceeding.
