Mr. Masora`presented arequest of Reno Offutt, for permission bti erect
a:3-foot. fence on city property to landscape around his Motel (Royal-
..Colony.) on the Manzanita Street side. The fence would protect .the.

landscaping. He would leave, a 5-foot sidewalk area.

Motion Adams, second Holbrook to appoint Dale L. Bartley to fill the-
unexpired term of William F. Saxbury, Mayor. Motion carried.

Names were submitted for consideration for the position of Councilman,
Ward II, to, fill,the,unexpired term of Dale L. Bartley. The following.
were submittedz Sterling 'Tucker, Mitchell. Hu11, Henry "Iiucky!' f Taylor;, `
and Dan Hadley.. Voting .was by ballot. Sterling Tucker was elected to
the position. Mr. Tucker wastadf~~sed{by telephone, of his appointment;
and invited to attend the meeting._
Bill Colley, of Colley REaI Estate, came before the council to request
a variance for-the Gulf Oil Company for 3-30 foot driveways to be '
constructed at the site of .their new.st.ation at Jewett and. E. Pine
Street. Motion Adams, second Robison to allow the 3-30 foot driveways.
Motion carried.
Mr. N.A. Mead came to the council to get clarification on engineering,
services in subdivisions. He said he had received several large bills
for engineers services in the Royal Heights Subdivision on .work he had
done to correct errors in, the paving. Mr. Mead stated that, the engineer
was Bill Warren', city engine'e'r. He felt ' if he had to pay his. ovum-
engineer, and then had to pay,.the city engineer, it was not~'far. Also,
he was never `advised 'of the charges that would be made for the-inspections.
Mr. Mason explained-the situation to the council. Mr. Bartley stated
that the city had a policy of not accepting improvements unless`~appr`oded,
by the city engineer. Motion Mushaney, second Ayres to table discussion
and refer it to the street committee for clarification o'f charges'
for these inspections and,a recommendation to the council at the '
next meeting.. Motion carried.
Sterling Tucker arrived at the council. meeting and was sworn.in by. ,, _
Mr. Bartley, as councilman, 'Ward II. ``
Mr.. M.C. Gleason carne to 'the council to ask what method the council
was using for street, improvement , the .petition method or by council
action.. He said the petition for `North First Street was not:; ,signed
by a majority ,of the property owners.. Mr. Gleason presented.fgures,.
but they did not agree with the figures presented by Mr Mason _of 54~
in favor and 45~ against. `The figures obtained from the county surveyor.
Motion Robison, second Holbrook to refer this matter to the•.st'reet "'
committee,_who will meet with Mr. Gleason to check into the matter. They
would try to~determine which amendment to the Charter is correct,` and
,also if 50~ of the property owners signatures on the petition-are
necessary by front~.footage or square footage. Motion ca~Fred`'` ''
Mrs. Grigsby, 444 ,N. First Street, advised the ,council that :unless
they stop all work' on -North First Street; she intends to s"eek~ an ~ `~'
.injunction. :She stated `that if the sewer line on N. First Street.is
changed and the street paved,, her'place'would be flooded. Mr.• Bartley
explained that the engineer had advised the council .that the situation
on N. First Street would be 'improved when the paving was ~finlshed
since'drainage~would be much better than it is now. He told"Mrs.
Grigsby that :he and~the street committee along with the engineer`-
would come down .to her home and explain what the plsns were. They would
advise; her when' they would meet. ~ '°. ~ '~

Mr. J.B. Reeder, atty, representing the Sacred Heart Parrish, appeared.
'before .tYie~ council to request that a `right-of-way, that was formerly
'used to'~o'to"the Main Sewer Plant, be vacated.- He said the city no
longer-used this road, sinr:e it now ended at Interstate 5 freeway.
The churches,plans to build on their porperty here, and will form a
`new Parrish to be known as St. Jude Parrish. Mr. Reeder said his
", 'committee had met with Mrs. Carr and Mrs. Germane, other property
owners, in"the area.
-Mrs: Germane wanted the church to give her an easement fora sewer
dine to .cross the church property, and also pay pa"rt of the costs-of
the sewer. line. Also, to exchange some land with Mrs. Carr and Mrs.
~.Germann.." Mr. Bartley said he understood the right-of-way would not
,be'vacated,..but would be. moved `over to be used for"street purposes.

`Mr..-Mason asked the council their feelings about hiring an inspector
~ to-;.do the,:.;street inspections during construction. Mr. .Bill-Warren.
~hadrecommended Mr. Dick Taylor, who .is a retired construction
f superintendent. Mr. Mason had told Mr. Taylor ,to go ahead and'ins,pect
'the work .until the council met. Discussion on whether the city
would pay Mr. Taylor or have Mr. Warren pay him.. The council felt
the cty,should pay him. Motion Ayres, second Adams to Hire Dick
Taylor as "inspector for street improvements and .pay him'with city
'funds. Motion carried. '

Mr Mason read a letter from the State Highway Departmeht regarding
the,'ciay~s`request for state aid on East Pine Street from 6th to 9th
Street; The letter stated the city would pro¢ably be eligible for
the aid,. however, they would like to widen the street'at, this point
to 44 feet.
`Discussion on load limits on paved streets. .Referred to the street
committee for recommendation.

`school District 6 requested 40 foot driveways on Cedar'Street near the
;`.bus'barla Motion Adams, second Robison to approve the 40 foot drive--
-- way. `Motion carried.
;Mr.'Mason reported he had a request from two residents living in the
.E vicinity of Ash Street and Freeman Road for a street light. They said
the area was too dark, and they had pprowlers. '
Motion Mushaney, second Holbrook to have Mr. Mason_check with.PPL on

Mr. Mansfe~l said he did not have the option ready on-the proposed
`purchase"of the Neidermeyer property on Bear Creek. Mr:~Mushaney
informed-the council that there was a deeded roadway on the property,
but other property owners have an easement to use the road.. ,

Mr. Mason .read letters ,from the .State.: Highway department regarding
the Interchange Lighting. and the speed conitrol on Rogue Valley Highway.
Motion Mushaney, second Ayres to instruct Mr. Mason `to write a nice'
letter to. William F. Saxbury, accepting; his resignation with, regret,
and thanking him for his .faithful interest and time to the office: `
of Mayor. Motion carried....-
Discussion on the early hours, of the Mt. .Pitt Company loading lumb~er~
on Sunday mornings. Mr.. Adams. reported. that they are workirig,as
early as 6:OOta.m. and disturbing the people in the neighborhood. "
Mr. Mason was instructed to check the nuisance ordinance on `this.
Mr. Mason asked.. the council if they would considerradoptz.ng {a} sign=
ordinance to control signs and sign'permits.',-Due to the increase
in the number,, of signs being erected, it is necessary to have a _
sign ordinance to follow. Also, he ~~ ahe -city. should establirtsh.
fees for filing of any annexation or'subdivision. Referred to the ,_
Administrative Committee for recommendations. .

council. Motion Mushaney to appoint Holbrook as Chairman of~_the ~`

Adams reported that he had attended the sewer study meeting.- Names
.are being submitted for directors for the State Sanitary Authority
Board. 'Filing must be done by Sept. 8, 1966.
Discussion on W. Pine Street improvement. BErt Adams said the curb
on ,his side of the street (+south side) extends farther than the ones on
the North side of the street. Mr. Mason said he checked with the
engineer, Bill Warren, and he said the street committee agreed on
~•this when they met and studied the-plans for all street improvements.
Mrs.-Gary Suthpin, 100 N. 10th Street, asked abouti~xthe drainage on
~ 10th Street when the street improvements are finished. She was
~ - worried about the water draining on her property, since it will
drain through a new cluvert from across the street and drain to her
~, driveway. Mr. Mason said the engineer had checked this, and said
CC_. - it..would drain properly.
Mr. Mansfield reported on his meeting with the Kights attorney,
Mr.. Paulsen. He explained to the council that they have agreed to
~• certain things, but wanted changes on others.
Mr. Bartley asked each of the councilman their opinion on~the agree-
ment.- Four councilmen favored the original agreement, and two
favored a new agreement.
Motion Adams, second Ayres that the city attorney advise counsel for
the Kght~•s that the city would agree to extension of time in which
to comphet•e construction till September 29, 1966. And that the
City is `agreeable to the provisions whereby the dismissal of the
"Kight vs Gilham" is withdrawn prior to any proceeding which might be
initiated based on furture conduct, but that the council will not
.approve settlement which does not contain a full release by the Kights
for liability, if any, based on past activities. The attorney
is instructed to iniate proceedings against the Kights on September 13,
1966, unless the Kights are agreeable to the above provision. Motion

Eloy Sutton, Asst. Fire Chief, asked the council what should be done
about; two -property owners, who had been notified of afire hazard
on "their `property due to dry grass and weeds. Nothing had been
done`to~correct the situation after letters had been sent to them. ''w>
Council advised to either contact these people personally or cite
ahem into -court. It was decided to contact them personally first.
:John-Robison said he would like to ask the council what was going on
that his son had not been re-hired as a patrolman. He said he felt
the administrative committee had no authority to hire or fire employees
or require that Ellsworth submit a letter from his doctor stating
that he was physically able to return to his regular duties as a
. patrolman: Members of the committee explainer that authority had
m, been_gven to Mr. Mason, Adm., to hire and fire, and the committee

had recommended that Ellsworth be advised by letter and .know this.
The committee felt that for the sake of Ellsworth~s welfare, due to
the nature of the operations he had and the type of work he would
do, that he should be physically able to return to his dob in•a
full capacity before he was re-hired. Mr. Mushaney asked Mr. John
Robison if his son, Ellsworth,.was in physical condition to assume
full patrolman duties. Mr. Robison stated that Ellsworth was.
Motion Holbrook, second Mushaney to have the Administrative committee
check the charter on hiring and fireing of .employees and report
back to the council. Motion carried.
