Roll call found: Adams,Holbrook,Ayres,Robison, Tucker;present. Absent: Mushaney. Also present: T~lasor.,~~a,nsfield,Tate. Minutes of t•he previous meeting were read and a motion was made by Holbrook, second by Robison, that the minutes be approved. Motion carried. The bills were presented to the Council for their audit. A motion was made by Holbrook, second Ayres to instruct the Recorder to draw warrants on the proper:::°funds for paying •them. Motion carried. ~.:.: Public Hearing-- ~ _ Attorney hTa,nsfield read proposed Ordinance No. 8 1, this being an Ordinance authorizing and ordering the construction of vra±,er supply facilities on Tenth Street in the City of Central Point, Oregon, authorizing the assessment of costs of said improvements against the property to be :benefited thereby; and providing that warrants issued for the cost thereof be general obligations of the City of Central Point. Diacussion-- Nfa.yor Bartley asked if there was anyone present opposed to the, ordina.nc_e. ' ~ No. one appeared. IIe then asked i_f there was anyone present in favor of the ordinance. Mrs. Germann and i~irs. Carr appeared. Motion Ayres, second Robison that Ordinance No. X51 be approved. Roll . call vote. All in favor. i~~Iotion carried. Ordinance hJo. g51 dec]a~red dlyl.' adopted. _ 1~irs.~Carr said the Catholic Church had made no indication to her about the three way exchange of property East of Scenic AYe. _ Jea.nhette T~7arshall,atty., and Mrs. Grigsby,l~l~~. N. lst, appeared before the council and asked about the N. lst Street improvements. They ;were advised by the Recorder that the improvement ordinances on N. lst • would be repealed. Anew petition was being circulated. The original ,t_ _ petition, dated 8/1+65 was declared null and void. ~Mr~.Mason reported to the council that the sewer line on N. lst must be°repaired or replaced before winter. If the sewer line installation was not to be made at this time, then something would have to be done on a temporary basis. Motion Robison, second Holbrook to call a meeting of the sewer committee to meet with the '~,ngineer,Bill j~Jarren, and study the problem. Motion carried. - Jeannette Marshall asked if the sewer line would be above the present line. Bartley explained that the council was concerned about the line, that was why they were having a meeting to disuss it, ~~~ Letter was read from Claude E. and Georgia Curtis,P.O. Box 12, Butte Fa11s, Oregon, objecting to the paving of Pd. First Street. The Curtiss stated they_ owned the follotiving described property: Lots 9-10-11-12,Block 12, Griginal Town, and was being sold on contract to Bruce and Joann Turner. Reginald Romine appeared before the council re: Regal Terrace Sub. Discussion was held on the proposed sewer line to his subdivision. The council voiced concern as to whether Mr. Porcine would be able to connect onto the Royal Heights Subdivision line, since they have had trouble in the past with the pumping plants. Ayres-and I~'obison said ,they felt the pw~np at. Kings 4°Jay would adequately carry the sewer from Romine~s line. Bartley expressed concern and asked why the city always had trouble with the pumping plants then. Letter was discussed, which had been received from Eng.,Bill ?Marren concerning this sewer line and the Schoold District 6 line from the proposed Jr. Nigh School. It was decided ~.o call fora meeting of the sewer committee, engineer,T~ason, and Mayor Bartley, to work out the proble.ns on the sewer line in question. Mason reported that the city had been offered °3,000.00 for the option they had on l~.nd Iv'orth of the city, Motion Adams, second Robison to turn down the offer for option. Motion carried. Letter was read from property owners living on Alder Street,. west of the tracks. They petitioned the city council to vacate 10 feet of the right-of-way on both sides of Alder Street from Amy Street to Haskell Street, since they felt the '`°- right-of-way of g0 feet would never be used. " Mr, h~ason asked the council if any of the councilmen and the Mayor were planning to attend the League of Oregon Cities T~Ieeting in Portland, Nov. 13-14-15. " Discussion-calling for bids ~on the new police car. Po7_ice dept. asked for I~eaver~ brakes and automatic transmission in the new car. Motion ,Adams, second Holbrook to call for bids and trade the 1964 Ford in. Motion carried. Discussion on whether to keep the Park attendant for the balance of the year. T~Iotion Adams, second Holbrook to keep Mr. Pepper on as park ~.ttendant. T4lotion carried. Correspondence: Letter from Frank Kock was read. Mr, Koch again complained of the fallout from the Cheney Mill. Petition from property owners requesting stop sign be placed at the; intersection of l+th and Laurel Streets. Referred to Police dept. ' and street committee. Letter from Jim Anderson, THE TINS, requesting permission to have a column on T;,S.P. Attorney A'~.nsfield said this would not be in vialation _ of any city ordinance.- Permission granted. Since the house was not going ~' to be built on the property on N. 10th Street, the council felt they should not allow the variance. .Motion I~iolbrook, second Ares to deny the request. Tvlotion carried,- ,Letter from Herman Kehrli advising the codification of Ordinances will probably be started in November. .Letter from ,State Speed Control Board stating they had, decided that 40 P~'H was reasonable for Rogue Valley Highway through Central Point, - and .will remain as the speed limit, - ,; _ _ s . , Letter from Bill Warren,Eng, requesting the paving of Haskell Street be delayed until next summer due to the possibility of having soft spots k where utility lines had bean aaid recently. Discussion on the .amount of base material to be placed during the waiting period. Referred.to teh.Street Committee. Letter~f'rom.State Highway that an estimate of the cost of improving ~a.st Pine Street from 6th to 9th would be about $5,000.00. The state "`probably would grant the city $25,000.00, however, the city would have _ ~ tp pa,y the .balance..They recommended the street be widened by'4 -feet. _ Discussion, on replacing-the sewer line .before the -street is widened. The Recorder was instructed. to write a letter to them advising they are in violation of Ordinance No. 817, and if .they work on Sunday, it would be necessary for them to start _ work after 8:00 a.m i ~° .~ Administrative Committee reported on their meeting. 't'hey did not have a final answer on filing fees for subdivisions, etc. Nor did they have recommendations for a sign ordinance. On the improvements for street projects, the Charter would be followed by requireing 5:~/ of the property owners {footage) to sign in favor. The owners of record at the County Recorder's office to be used. Mr. Mansfield stated that the record of ownership at the Assessor's office would be used for assessing. ` On the question of tirhether Mr. Mason, Administrator, had authority to hire and fire employees, T~Ir. P~.son read Ordinances Pdo. 4813 and Ordinance Pdo. 728 and the minutes of May 5,1yb4. The administrator was given authority in those ordinances and minutes by the council.- Discussion on whether to continue the sewer use charges after the sewer bonds are paid this year. Revenue necessary for maintaining, repld,cing sewer lines and for service. Motion Ayres, second Holbrook to instruct attorney to prepare Ordinance and call for Public, Hearing;November 1, to continue sewer use charges. ~ PfIotion carried. Mr. P~Iason was instructed to have the right and left turn signs painted at Pins Street and Hwy 9y. - l~.r~. Bert Adams, 119 W. Pine Street, asked for a variance on the curb cut on his property at W. Pine Street and Haskell Street. He is building an apartment house facing Haskell Street, and wanted a full~'_curb cut so that he could, back trailers into his trailer park. Motion Robison, second Ayres to allow the variance` of a full curb cut on West Pine Street, and on Haskell Street only allow as many driveways as the ordinance allows for the length of his property. Motion carried. Piss. Pnura Mi.lls,213 W. Pine Street, requested the council check into the problem of placing the on her property at tit. Pine Street and Haskell St. for drainage. Referred •to the street committee. Attorney Pansfield advised the council they should consider revising and updating the , ~il.di.ng Code ordinance. He i~ras advised to work on - an ordia~nea to incorporate the latest Uniform Building Code. Attorney Mansfield presented a statement to the council for extra work done by him on the Kight,Seils,C~ilham case. The statement was for X1,000.00. He said he tiaould be glad to go over the statement with;the council. He had an itemized list of the hours worked. Ref erred to the administrative committee. PIr. M.C. Gleason appeared before the council to ask for the resignation of \ Chester L. Ayres,councilma•n. Mr. Gleason said Mr. Ayres violated .the charter by serving as a councilman while also doing business with the city. The - char-ter stated that no officer of the city shall have any interest in a contract with the city. P~'Ir. Gleason also stated he felt Iv1r. Ayres should pay back all- the money that had been paid to him by the City. He listed several amounts he had taken from the minute boolk. ~~0 -Mr. Gleason was advised that the city-had a contract with Tidet~ra,ter Oil Company (now Phillips 66) to dump gas at Chets Service Station. P!tr. Ayres _ pumps• the gasoline for 2¢ per gallon. The matter irould be checked:~by the - cty~attorney. Gas had been pumped at this station before T~Ir. Ayres took it over. Mr.'.-Ayres told Mr. Gleason he had already rescinded his business agreement with the city to pump gas. TTe•did not have'a contract with them. Motion Holbrook, second Robison to rescind the business agreement with Ayres, motion carried. - ~ -- Mr: -Robison said he had already contacted three (3) firms about bidding on city contract to pump gas. Discussion on 15 minute parking sign in-front of Livingston's liquor - .~, store: ~ The.;Police Department was advised to police the parking. Mr. N~ason ~ was instructed to write Mr. Livingston a letter advising hire that the ,police would do the best they could about policing the 15 minute parking. However, he should not .call the department everytime someone overparks a few minutes. The Police Department, does not have enough manpower to stay ~the~ or run dorm every time someone calls.
