Roll Call found: Adams,-Ayres, Holbrook, Mushaney, Tucker; present:. . Absent: none. .John Robison passed away October 25, 1966. • ` Also present: Mason, Tate, Mansfield. °Minutes of the previous meeting were discussed. Motion made. by Tucker that the minutes be corrected to read: (page 40~,_para 3)` " "Letter-from Jim Anderson, THE TIMES, requesting permission to have a column on E.S.P. Attorney Mansfield said this-would`not be in " violation of any city ordinance. Mr, Anderson explained that • E.S.P. meant Extra Sensory Persception. The"Council did not feel Y~ _ permission was necessary.-"~ Motion Adams, second Ayres to approve the - minutes with•the proper alterations. If recommendation is the low bid, instruct City Recorder Mason to order the car.. Motion carried.. ,. ". Mr." Lee came to the council to request permission to have license ` for a business for Palmistry. Discussion was held. Attorney Mansfield was instructed to check the matter and report to the.counci•1 at the next meeting. Mr.~Lee was advised to attend the next meeting for a `decision:' D.D. Turner, Sr., Fire Chief; requested the city council adopt'some, regulations for the Fire".Zone, which would give the city more definite .regulations ~o follow. Also, penalties for any violations, -Ui cussion on the matter was held. Mr. Mushaney said he had a draft of some regulations that had been worked out before. Mr. Turner said this-was " what he: had in mind: Mr: Turner said'he had a codplaint about the Har--ley-Davidson garage using.a'welding torch in a frame structure, which"was located in the `Fire Zone. Since the city did not have definite regulations to cover - ': this, he was unable to do anything but talk~to.the owner about being careful .with the welding and•see:that it was done outside.- ~- Mr.. Turner read a letter from the ,American Fire Protection"Company quoting the price of $3,987.00 to install a Hale front mount pump • on the ,Chevrolet Truck. This would be completely installed. The terms could be arranged to. pay one-half of the amount on delivery and the balance after August, 1967. Referred to Fire Committee and Mr. _~ Turner. . f 4 ~ ~~~ 1: 41_ Attorney Mansfield Read Ordinance No, 852, this being an ordinance relating to general obligation construction warrants, and amending ordinances numbered 810,841,842,843,844,845;g46,g47, and 848. To change the interest rate from 6~ to 4~. Motion Ayres, second Adams, to approve Ordinance No.,852. Roll calk. vote. Motion carried. Ordinance No. 852 declared duly adopted. Ordinance Nom. 853 was read, this being an ordinance adopting the 1964 Uniform Building .Code, repealing Ordinance No. 289 and all others pertaining thereto,. with amendments. Motion Adams, second Holbrook to approve Ordinance No. 853. Roll call vote. .Motion .carried. Ordinance No.. 853 decalred duly adopted.- City Recorder Mason presented the North First Street (Pine Street to . _ the Northerly.; end of First) petition to the council. .Mr: Mason reported that there were yes, 1,678.25 feet'; No, 1,156.77 feet. This would be 59.55 in favor and 40~ against, the street improvements on North First. Motion Holbrook, second Ayres to duly accept and file the North First Street petition as approved. Roll. call vote. Motion carried. The Administrative Committee made a report on their meeting regarding Chet Ayres, councilman. At the last meeting, Mr. M.C. Gleason had ~ appeared before the council to ask for the .resignation of Chester L.._ Ayres, councilman.;."Mr. Gleason said Mr.'-Ayres had violated the charter by. serving .as a councilman while also doing business with-the:: city. The charter stated that no officer of the city shall have any interest in a contract with the city. .Mr. Gleason also stated he ~ ., , flet Mr. Ayres should pay back all the money that had been paid to < him by the city. He listed several. amounts he had taken from the minute book. Mr. Gleason was advised that the city. had a. contract with Tidewater Oil (now Phillips 66) to dump gas at the Chets Service, Station. Mr. Ayres pumps the gasoline for 2¢ per gallon. The matter ". Would be checked by-the city attorney. Gas had been pumped at . this station before Mr. Ayres took; it over. Mr. Ayres told Mr. ~.-~ Gleason he had already rescinded his business agreement with the ~. city to pump gas. He did not have:a contract with them." ~, The: Administrative committee said no action would be taken by the .,_ council, as requested by M.C. Gleason, to ask Mr. Ayres. to resign and refund the money he-had received from the city im payment for services. With recommendations ~r6 the city attorney. _ } ... Attorney Mansfield advised: 1. No statue requires money be repaid. 2. Mr. Ayres not subject to removal. Therefore,.not required to resign.Council;agreed 100.- - '..; Motion Adams, second Mushaney to,accgpt the administrative .committee report as presented: Motion carried. .~ - Discussion on Title Companies. 4~3: Quotations for pumping gasoline were read by Mr. Mason: She11 0i1 Company-regular gas 22.0¢ ethyl 25.9¢ less tax, plus 2¢gal.to pump. Mobil Oil " " " 24.9¢ " 27.9¢. '. Motion Adams, second Mushaney to accept the agreement with Shell Oil Company to pump gas for the city. Motion carried. .Attorney Mansfield advised the council they would have to meet not:t_m~-ter ~~than 5 days after the election to canvass the ballots. A special meeting wi]a be held November 10, 1966 at 7:30 p.m. for this purpose. Discussion on Sewer Use Charges as outlined in Ordinance No. 284. ~. Mr. Mason presented a request for a street light to be installed .on • N, 10th St. near the Lutheran Chruch. ~ , . _: ;. Motion .Adams, second Mushaney to install the street light. Motion carried. Motiori,Mushaney, second Ayres to recommend to the County Court that they rename Hanley Road -(from Jackson Creek to the Westerly City `'Limits of Central Point} to West Pine Street. Motion carried. . Discussion-petition for stop sign at corner of 4th and Laurel St. •as,presented at last meeting. Police report said they did not feel it would be necessary for a stop sign at this corner, since it was ° unobstructed view. Motion Ayres, second Adams to deny request for stop.~;sgn at 4th and Laurel St. Motion carried. Mr.=Mason reported on the air pollution problems: Mr.~Gheney of the Cheney Forest Products answered Mr. Mason's letter, and~~advised that he would meet with the city council and discuss the burner at the mill. - On'-the letter sent to Mr. Collins of the Mt. Pitt Company, he answered by inviting the council to tour the mill and see what .had been done. Most .of the council had toured the mill duringa luncheon meeting and'was informed of the improvements be~:ng made. Mr. Collins had also 'sent,a letter from the State, showing that the Mt. Pitt Company had complied with the .requests of the State, and thanked them for their cooperation. Councilman Mushaney suggested the Mt. Pitt, Cheney, Grange Co-op have an open house to .show the people of the area what is being done in each of the businesses. The council had been surprised at the number of ppoducts the Mt. Pitt Company made at their plant.- D.D::~Turner, Sr., Fire Chef, commended the Public Works Department for.~~the completion of the water line on W. Pine Street. He also thanked the council. He said the added pressure was very. good and made;.the fire protection much better. Mr.~Mason read a letter that had. been sent to Myron Corcoran by 4~.. Bill Warren, engineer, advising him not to proceed with the installation of any water lines in the Central Valley Subdivision until the plans had been submitted to him 'and checked. Mr. Corcoran had already moved one fire hydrant without the city~s permission. Motion Holbrook, second Ayres to approve the above applications. Motion carried. Discussion-should council start on traffic light installation at 3rd St. and E. Pine Street. Reservation for the League of Oregon Cities meeting November 13,14,15.° Letter from City of Rogue River on passing of John B. Robison, councilman. Discussion on the Robison vs. Kight case, now that Mr. Robison has passed away. Attorney Mansfield said the District Attorney would probably dismiss the assult and battery case against Eva Kight.
