Special Adjo~zrned Meeting
7:30 p.m.
The Common Council met in special adjourned session with Mayor Bartley
presiding.
R,o11 call found: Adams, Ayres, Holbrook, Mushaney, Tucker; present.
Absent; none. Also present: Mason, Tate.
Mayor Bartley stated the purpose of the meeting was to canvass the
returns of the election of November 8, 1966: He said the council had
a decision to make in the election of a councilman for Ward II, since
there had been a tie vote between Sterling Tucker and Henry Taylor:
Each had 72 votes.
Recorder Mason read from the Charter, Section 8, which said the council
may decide in the case of a tie vote. Mr. Mason also read proposed
Resolution No. 140, canvassing the votes of the election. "
Mayor Bartley asked the council if they would like to ask any questions
of Mr. Tucker or Mr. Taylor before they-took a ballot. Questions.,were
asked, and then the candidates left the meeting. Voting was.done by,
secret ballot. Sterling Tucker was elected to the position of councilman
Ward II. The candidates returned to the meeting and were advised of
the voting. Mr. Taylor told the council he fit they had been fair
in their voting.
Resolution No. 140 was then presented to the council for their approval.
Resolution No. 140 being a resolution canvassing the returns of the
election of November 8, 1966, declaring the results thereof and
directing the delivery of certificate of election.
WHEREAS, pursuant to the laws of the State of Oregon, and the
Charter of the City of Central Point, the regular biennial election
of the City of Central Point was held within said city onfthe 8th
day of November, 1966, at which time and place the registered voters
of said City cast their votes for the purpose of electing the following
officers of said City:
Mayor
City Recorder
City Treasurer
One Councilman from Ward 1
One councilman from Ward 2
One Councilman from Ward 3
and
WHEREAS, the County Clerk of Jackson County, Oregon, has
delivered to, and filed with, the City Recorder of Central Point,
Oregon, an abstract of the votes cast at said election; and it appears
therefrom that the following persons received votes from the several
offices as hereinafter set forth:

OREGONs.
SECTIONI. That the following candidates for Mayor, City Reorder,
City Treasurer; Councilman`~Ward 1, Councilman Ward 3, of said City at ~'~:
said election received a majority or clear plurality of the votes
cast~for each office:

For City Recorder Freeman W. Mason
:For Gity Treasurer F. Lorain Tate

SECTION 2: That pursuant to the.. Charter pff'the City of Central
Point, Article IV, Section 8, it is hereby determined that two
:.candidates, to=wit Sterling Tucker and Henry B. Taylor, have an equal
and the highest number of votes for the office of Councilman Ward 2,
and. pursuant to said Section the common council does hereby decide
the-election by determining that Sterling Tucker shall be and become
the 'councilman for said Ward 2 for the term of office for which said
election was held.
`:SECTION 3; That the persons named in Section 1 and 2 hereof are
hereby dec~~red elected to said offices set opposite their names in
sad section, for the term specified for each such office in the
. -Charter of said City and the City Recorder is hereby directed to
issue~to each of said persons a certificate of election over the
eal~of the City of Central Point, Oregon.

Motion Mushaney, second Adams to adopt Resolution No. 140, with the ,
name of Sterling Tucker i.~serted as Councilman, Ward 2. Roll call`
vote. FI't3tion carried. Resolution No. 140 declared duly adopted.
Discussion was held on the handling of the City vs. McGrath case by
the District Attorneyts Office. It was felt the city attorney,
Recorder, and Mayor should meet with the District Attorney to get
an explanation.
There being no further business, motion Mushaney, second Ayres to
adjourn to the call of the Mayor or the next regular meeting. Motion
carried.
