Roll call found: Adams; Ayres, Holbrook, Mushaney,~Tucker; present. Absent none. Discussion of the minutes of the previous meetings minutes, as mailed to; each councilman. Motion=~Mushaney,.second Adams to approve the minutes of the previous :meetings. Motion carried. ~ discussion--Planning Commission minutes. ~ .. ~ ~ ,: _~ Attorney Mansfield read proposed Ordinance No. 854,this being an ~ ~ordinarice approving the plans and specifications for the construction of paving,.curbs, and gutters on First Street between Pine Street .to Northerly end of First Street in the City of Central Point, Oregon, describing the real property to be specially assessed for the cost of ,` said project; declaring the council's intent~to cause construction of said ..improvement and to assess a part of the cost. thereof to .adjacent - properties-which are specially benefited thereby; providing for a hearing of the council to consider protests .against said improvement project; providing for the giving of notice of said hearing; and repealing ordinance No. 837. (Public Hearing Jan. 3, 196.7) ,.Motion Ayres, second Adams to approve Ordinance No. 854. Roll call vote. All in favor. Motion carried. Ordinance No. 854 declared duly adopted. ~Mrs..Jeanette Marshall, attorney for Mrs. L.E. Grigsby, 444 N..1st St. ,y appeared before the council to .request deferment on the construction on N,. First Street... She stated that Mr. John Robison, former councilman, now deceased, had said the sewer line and drainage. needed more study. She said she had pictures of the area around the Grigsby home during the last hard rain. ~:1. picture showing that rain had caused difficulties in getting in and out .of the driveway. 2.. picture showing the water across the street at the Crabb. property. 3. picture showing rear of the Grigsby's garage and house. She-said they felt if the street is constructed, a storm .sewer should be constructed first. Also, the sewer line should be changed, since she felt the waste would not run up hill. The Grigsty's felt that it was not necessary to pave. beyond Maple Street, since .the street beyond. that~was a dead end street. Mrs. Marshall said the surveying that had -been done on the street. was incorrect. There had beef several.- contro- - versies in the past about the right=of-way on First S~reet, so the street"'as planned would not be correct in her opinion. If the council chooses to go ahead with the project, it might resolve ~,in a litigation. The new councilmen should be informed as to the stv:ation so the council should holy up the project until after the new 4:21 2~ council has been sworn in. Mrs. Marshall said if the street was constructed, it-would require removal of trees and part of the - Grigsby~s garage. This would decrease the value of the property. Mayor Bartley advised Mrs. Marshall that the people on N. First St. had petitioned the city council to improve the street. The council had acted on the petition, and were calling for a Public Hearing at the next regular meeting'of the council. At that time, anyone cane be heard, either for or against the improvement. Mr. Bartley explained that the council was trying to do everything fairly. Plans were drawn to drain the street into the sanitary sewer at this time. No changes have been made in the plans since the last time Mrs. Marshall had obtained them. - r Attorney Mansfield read proposed Ordinance No. 855, this being an ordinance prohibiting larceny, and providing penal~,ies. Motion Holbrook, second Tucker to approve the Ordinance No. 855.._ Roll call vote.. Motion carried.- Ordinance No. 855 declared duly adopted. Attorney Mansfield reported on his research on Palmistry--ordinances in other cities. He said most cities prohibit Palmistry° - Motion Ayres, second Adams to continue to prohibit Palmistry. William Baum, 1020 Oak Street, said he had trouble with his sewer line since his house had been built in 1957 by T. Whittle. He felt the city should do something to help him with the line, since he must clean it out regularly. Mr. Mason said they would check out the situation, and see about replacing the'sewer line. Mr. M.C. Gleason asked the council if he could be heard on something regarding the Charter. He asked why the council had not followed the Charter by appointing a councilman to replace the council seat vacated by the death of John Robison. According to the way he read the Charter; the council was supposed to appoint- someone as soon as possible: Mayor Bartley explained to Mr. Gleason that he had asked the council to consider a councilman after election. They had planned to appoint-one in January. Mr. Bartley said the council was going by the same Charter that Mr. Gleason had gone by when he was on the council. How could he justify changing the proceedures now. - Mr. Gleason also talked about the parking situation in front of the. liquor store, Mr. Pepper as park Attendant, and N. First Street paving petition. Mr. Mason advised Mr. Gleason that the council had talked of drafting a new Charter as part of the work the League of Oregon Cities was doing 9n the Ordinances. Mr. Mansfield said he would take the Charter and study it and draft a proposed one if the council desired. Motion Ayres, second Adams to instruct the City Attorney to study and draft a new charter. Motion carried. D 1 n 4 2:3 Mr.•R.D. Tolvstad, Pacific Northwest Bell Telephone Co., appeared before the council to request the city approve an Ordinance to allow the telephone company to install booths on city property. Proposed locations now would be in front of the City Hall, and in front of the American Legion Hall. The booths would be fully enclosed with glass and illuminated. The booths would be installed by the telephone company at no cost to the"city, The city would receive 15~ of the gross revenue. The council would decide on each booth to be installed. 'Sttorney Mansfield said he .would take the proposed ordinance as presented by the company, and study it.-''He would re-draw an ordinance if necessary. - -Myron Corcoran, subdivider of the Central Valley Subdivision, appeared . before the council to clear up differences on whether he should be " re-imbursed by Mr. Mead for connecting onto a water line installed ~ in West Pine Street. He understood the city had promised to reimburse ~' him-one-half of the costs of the line. Mr. Corcoran was asked if he ~,; had". even the cit a co of the costs of the line. He had not. g,~ y Py ,, ~ ~ It±was brought out in the discussion, that other. property owners had shared in the cost of the line. Mr. St. Arnold, Porter, Gutches. Some of these people"had not wanted'to pay for any of the line at this _ time, but since the line ran in front of their property, they were forced to pay their share per foot:. Should these people have reimbursed ahe`,people who had paid for the line they had connected to that was in ` exist'snce. Some of the council felt this could never be setted.by re-` ~•imbursement, since they would have to keep going to the original lines, ,etc.' Since the subdivider wanted the service, the other people shared in.tfie costs, the~line became city property as soon as the line was in ~use~.~.Therefore, it would not be the property of Myron Corcoran. Motion~Ayres, second Holbrook to refer to the Planning Commission for ..their htudy and recommendation. Motion carried. Liquor licenses were presented for approval: Faber's Market Pioneer Cafe '. Three Boys Market Moton.Adams, second Mushaney to approve the above licenses:,.Motion ..carried. ~Mr.~Mason read a letter"from,engineer, Wilbur L. Warren, stating that the following streets had been completed except for minor clean-ttp. He. had`also held-back 10% of'the costs until completion. The 'streets ., were: W. Pine St. (Amy to' Haskell), Rostel Ave., Cedars Street (Fourth St. to Freeman~Road), N. 10th St. (Pine to Manzanita), lOth'Street (Maple. to Hazel), S. Third Street (Oak to Ash).; Moton°Holbrook, second Adams to accept the streets W. Pine St., :Rostel Ave,, Cedar Street,`N. 10th Street (Pine to Manzanita) and N.:. 10th St.-(Maple to Hazel), and S. Third Street (Oak to Ash)., only to secure financi~.l obligations and for Bancroft Bonds. Roll call vote. Motion carried. r ~. ~~~~ Letter--George Johns, Principal at Richardson School complained to the council about the fall-out and air pollution from mills in the area of the school. Letter--American Fire Protection-re: agreement to install pump on fire truck. Motion Holbrook, second Mushaney to instruct Recorder and Mayor to sign the lease-rental agreement for the installation of the pump. Motion carried. Discussion-insurance for ommissgons and errors and false arrest. Mr. Mansfield explained. Mr. Wilbur L. Warren explained his recommendation to the council for the sewage pumping station in the Royal Heights Subdivision for the proposed connection of the new Junior High School. The new system would have a de-humidifier, three phase power, all controls on the pole outside the pit. This would eliminate some of the problems of. \~~ moisture as exists now. They would be duplex pumps with no compressor. t~/ Cost: approximately $4.600.00. He felt-this would adequately handle the ~,,cl' '- Junior High and the subdivision for the present time. This is based ~.i o~ ~ on an estimate of 1200 students. '(Mr. Warren, Mayor, Mason and 2 ~~bo councilmen to meet with the School Board, Tuesday, Dec. 13.~ Costs for school were requested by Mr. Meyer. Mr. Warren said the bids on the Scenic Ave. water line would be called for Jan. 3, 1967 at the next regular meeting. The estimates were: ' transite-$8,411.50, cast iron-$9,804.00. City to pay for the difference in the cost of the 8" pipe over the cost of the 6" pipe. Mr. Mason asked the council if they felt the city should have an ordinance pertaining to leaves disposal. Several inquiries had been made as to whether property owners could rake the leaves into the , street far the city to dispose of. Referred to the Planning Commission. Discussion--traffic problems-Pine Street and Hwy. 99. Mr. Mason was advised to discuss it with the Sate Highway Engineer and see what. could be done. Mr. Mansfield discussed deliquent assessments with the council. Expenditure for traffic light on. Third Street and Pine Street had been budgeted under operating contingencies from anticipated receipts of Cigarette Tax. Since one--third of this anticipated revenue was received in the first quarter, Mr. Mason recommended that the council call for bids. Motion Holbrook, second Mushaney to call for bids on the traffic light at 3rd Street and Pine Street. Motion carried. The bills were presented to the council for their audit..
