Absent; none. Also present; Mansfield,-Mason, Tate. Minutes of the previous meeting were discussed as mailed to each - . member of the council. • Motion Mushaney, second Adams to approve the minutes with the correction, page..424 of the minute book, Cost of pumps X4,600 each. Motion carried. ;The bills were presented to the council for their audit. A motion was ~ '`made by Mushaney, second by Holbrook, that the bills be.approved and . the recorder be instructed to draw warrants on the proper funds for .. ~ payng`them. Motion carried. - •:_ Recorder Mason swore in Dale L. Bartley as Mayor. . Mayor Bartley-swore in the following elected officers: Harry L. Tonn, Councilman Ward I Robert Walker, councilman Ward III Sterling Tucker, councilman Ward II ` F.W. Mason, recorder ~ • ' '. F. Lorain Tate, treasurer Nominations were made for a councilman to replace the late John Robison, ' "-councilman at large. Ray Novasad, Henry-Taylor, Chet Ayres ".Moton'Holbrook, second Mushaney to close the nomination. Secret ballot was taken. lst ballot was a tie vote. 2nd ballot elected Chet Ayres. He was then sworn into office. Motion Mushaney, second Ayresto elect Warren Holbrook, chairman of the council. Motion carried. Mayor Bartley made the following appointments: -Police Chief, Edward J. Zander Fire Chief, D.D. Turner, Sr. Ass"t. .Fire Chief, Eloy Sutton City Adm., Freeman W. Mason Building~Inspector, George Gilham .Attorney, William Mansfield ' Givil Defense Director, Freeman W. Mason Public Works Supt., Vernon Capps ' Municipal Judge, John H. Chaney -,Deputy City Recorder,'F.. Lorain Tate MotioniWalker, Tucker to approve the appointments as made. Motion carried. Publc~Hearing--North First Street improvements. 4~ 2 7 ~~~ Attorney Mansfield stated that his office had made a typographical error in Ordinance No. 854. Mrs. J. Marshall, attorney, had called this to his attention. Mr. Mansfield recommended repeal of Ordinance No. 854, and pass anew ordinance calling~.3for a Public Hearing on Feb. 8,.1967. This would not hold up construction, and the cost would only be for the legal.publication., Mr. Mansfield said he would not. recommend taking a legal risk by going ahead on Ordinance No. 854. Mr. Mansfield said he had an ordinance prepared, which would repeal Ordinance No. 854. It would be the same, except for the correct dates. Attorney Mansfield. read Ordinance No. 856, this being an ordinance approving plans and specifications on North First Street from Pine St. to the Northerly end of First Street, and calling for a hearing Feb. 7, 1967 at 7:30 p.m. Motion Mushaney, second Ayres to approve Ordinance No. 856. Roll call vote. Motion carried. Ordinance P1o. 856 declared duly adopted. Letter from Mrs. M. Offutt requesting her name be removed from the petition for improvement of N. First Street. Attorney Mansfield advised the couhcil they .could grant withdrawal of her name. However, r, it was not necessary, since the petition had been approved at a prior meeting. Both husband and wife would have to sign a petition to make it legal, or both remove the names. Motion Holbrook, second Mushaney to table withdrawal of the name. Motion carried. Planning Commission minutes were discussed. Rodney Hall 4 plex-Lot 2, Block 36, Original Town. Motion Mushaney,. second Tucker to approve the 4 plex for Rodney Halh Motion Carried. Hilda Allsup, 319 w. Pine Street, request for antique shop in her home. Attorney Mansfield advised council this would not be permissible according to the ordinance. Motion Holbrook, second Mushaney to deny request. Motion carried.: M. Corcoran request from the city for reimbursement of cost of installation of service lines to his subdivision on West Pine Street. Tonn reported the Planning Commission had been informed that the city attorney and engineer had studied this and had no solution,. so the Planning Commission did not see how they could solve it-:either. Ayres felt the Planning Commission should study it again, since the. city will be faced with the problem again. Referred back to Planning Commission and have them meet with engineer. Engineer Warren for confirmation and referral back to the council. Motion carried. Don'Hirschy spoke to the coun+~il about installing cast iron instead of traneite pipe for the water line. Ed Zander, Chief of Police, spoke on the storage of-explosives within the city. He had talked with the attorney prior to the council meeting. Zander said he had a problem within the city now, of explosives being stored. Attorney had advised using the Nuisance Ordinance (storing explosives in a home is possession. Discussion on Fire Code ordinance. C~ Attorney Mansfield explained proposed Ordinance No. 857, this being an~.ordinance granting a permit to Pacific Northwest Be11 Telephone to in tall telephone booths on city sidewalks, method of removal,, and revenue. Motion Holbrook, second Ayres to approve Ordinance No. 8~7. 'Roll call vote. Motion carried. Ordinance No. 857 declared duly adopted. Discussion on agreement with the City~.of Medford Water Commission. for 20 years. Mr. Mason said Mr. Lee recommended meeting with council _to discuss it. Tabled until future date. • ~ Discussion on proposed vagrancy ordinance changes `Motion Ayres, second Walker to table proposed ordinance and refer to Police Commission and Chief of Police for study. Motion carried.. Attorney Mansfield discussed jury trials ordinance. Selection of -jury to be changed to read, "10 or more jurors to be called at trial time-to be examined at that time. Jurors to be questioned under oath". Attorney Mansfield then read proposed ordinance No. 858. r Motion Mushaney, second Walker to approve Ordinance No. 858, repealing Ordinance No. 521. Roll call vote. Motion carried. Ordinance No. 858 declared duly adopted. . Correspondence: Letter from CH2M pertaining to legislation for sewer plant installation, Federal to pay 50~, State 25~, City 25~. . Letter from Charles A. Meyer, School District 6, regarding pumping plant for new Junior High School. Councilman Mushaney reported on a meeting a committee and Mr. Mason had with the_ School Board. Mr. ;Myer asked if the present pumping plant was a lemon. Mr. Gehlardi stated that since the city had had so many problems with .the present plant, he felt the city should share in the cost of the pump installation. When asked about:ithh.~cost of maintenance of the existing plant, Mr. Mason stated it was about $500 per year. Mr. Tucker said they had`advised the school board that the city had not planned to make any change in the plant, until the School had requested to be X30 Councilman~Mushaney said a letter should be written to the Sbhool Board advising them to put in their own line down to Upton Road at their own expense, if they felt this was too expensive. It would probably cost them $15,00 or more. Councilman Ayres stated that the school had discussed all of the details with the council, ~,nd had allowed far the installation in their bond issue. He .could not understand why . they wanted to bring this up now. Mayor Bartley said the school felt they should not have had to pay for a building permit. They felt the money they paid for the permit should be applied back to them. on the cost of the pump. Mr. Mason informed the council they had to obtain a permit, since it was part of the requirements in the building code ordinance. • Motion Mushaney, second Tucker to. instruct the Recorder to draft a letter to the School Board advising.them.of the opinion of the council. Letter to be sent to the School Board after it has been approved by the administrative committee.. Motion carried. Mayor Bartley read a letter from Mr. Mason,, stating the condition of the city and the improvements and progress made in 1966. Discussion proposed new city charter as drafted by Mr. Mansfield. Planning Commission appointments recommended by Mayor Bartley: Hemry Taylor to replace Harry Tonn-Term expires 1968. Norman Bruce-reappointed for three years. Lewis Cox-reappointed for three years. Motion Tonn, second Walker to accept Mayors recommendations of appointments for Planning Commission. Motion carried. Mr. Mason distributed copies of the audit for X965-66 and copies of proposed zoning maps and ordinances. Discussion on dog control. Referred to police department.
