Roll call found: Adams;: Bartley, Britton, Holbrook, Patterson '. and Robison, Fresent. Absent; none. Also `present, Mason, Tate, Mansfield.. Motion Robison, second Britton that the previous minutes be approved as sent to each councilman. Motion carried. ' Public Hearing-proposed construction of Jehovah~s Witness Church"'on Lots l and 2, Block 1~0, Original Town (5th and Oak Streets). T+To one appeared. Motion by Robison, second'by Adams to adopt Resolution-No. 137, this being a resolution allowing a special permit to construct a Church upon property therein described, Lots 1 and 2, Block 40 Original Town. Roll call vote. Motion carried. Resolution No. 137 declared duly adopted., Mrs. Willie Germane'presented a letter to the Council concerning tTie service of water and sewer to the Pinecrest Subdivision (proposed) on Scenic. Avenue. Letter attached. ~' ! Attorney Mansf.'ield advised the Council that they could put in the i ,=~ ~ trunk line down Scenic Avenue and charge the property owners, who would '.benefit; on a square foot basis This could be Bancrofted: Then; ~,-,~ `anyone connecting to the trunk line would have to pay for tNe;lines--' ~~, ''~ leading to their property: Or, Mrs. Germane could pay for the~Tiiies and the City would re-imburse her for anyone connecting onto the line. The re-imbursement would be made from the connection charges.` Attorney recommended the Engineer make a study to see how marry,people would benefit from the trunk line, and then plan from there. Motion by Bartley, second by Holbrook to refer the matter to the Sewer Committee for study. Motion carried. Attorney Mansfield read Ordinance No. 809,. this being an Ordinance dispensing with an election within the City of Central Point, on the question of a proposed annexation and setting the-time and place 'for a Public Hearing thereon. (Mead, School District 6 Miller properties), Hearing set for February 17, 1966 at 7:30 P.M. in the Council Chambers. Motion by Robison, second by Adams that Ordinance No. 809 be approved. Roll call vote. All in favor. Motion carried. Ord. #809 declared duly adopted. Noel Moore, Builder, asked the Council if this Ordinance meant that the Mead property had not been annexed. He had been told that it had been annexed to the City a month ago. Attorney Mansfield informed Mr. Moore that it was ,not in the City, and would not be until after the.Public Hearing. Mr. Moore asked if he would be issued building permits on this property'before it was annexed. Mr. Mansfield said the Gity could not issue any permits until the property had been annexed to~the City. Mr. Mead stated that he had done everything. possible to satisfy the City, and had been told that the property had already been annexed. Therefore, he had sold the lots to Mr. Moore and told him he could go ahead and build. This delay would cost both of them,, ILA L~ D ,: ~ After discussion, a motion was made"by Adams, second by Holbrook to amend Ord. #809 by setting up the Public Hearing date to February 17 1.966 at 7:30 P.M., instead of March 1,.1966. All in .favor. Motion carried. ~Mr. Frank Koch presented a set of plans to the Council for discussion. He plans to build a 11+ unit apartment house on the corner_of South First Street and Cedar Street. He would build.? units now and 7 later. .He'"was"advised to present it to the Planning Commission, first, for .approval. 'Ray George, 352 N. 1st Street, came to the Council with a group from North First Street. They complained. of the sewage backing up into their " homes'durng rainy weather. They were wondering if the City was going to do anything about this sewer line before the street is paved this ~. =next year::" Mr. Mason said they had planned on correcting this situation. However; Mr. Capps, Public Works Supt., told the Council the line" . could.not`be lowered anymore: Either the: street would have to be built up`or a'pumping plant installed.. There are several people on North First, `who .are unable,to connect to the sewer line because it is not .deep. enough ~, After some discussion, it was decided to table-the matter for' _ °study~by:the.sewer committee. -Mr. Sam Dykes, Central Point Auto Wreckers, 544 N. Front Street, appeared before the Council as requested by the Police Department asking him to 'clean up some of the unsightly cars in front of his place of _ business..`•He is in violation of the State Statutes by having. more than the 8 cars which are allowed to be displayed in front of his business. ~Chef:Zander presented pictures to the Council to show the violation. Mr:.,Dykes stated that he was going to double deck the cars inside his fence. However, if they were visible -from the outside, they would be involation of the City code. Attorney Mansfield told Mr. Dykes if ~~he`d'd-not-remove all of the cars, but the allowable number, he would `be~-subject to prosecution by the District Attorney. Mr. Dykes said he~would `clean up the property, 1 Attorney Mansfield presented a letter to the council in reply to a requ'est` th`e Council made on January 4, 1966 for him to re-examine -the zoring~ordinances and advise as to whether or not trailer houses are -'permitted in any Zone other than Zone IV, Heavy Industrial district. Mr~:. Mansfield reported that in his opinion, trailer houses are permitted only ri"Zone IV, Heavy Industrial district. This of course does not prohibit trailer houses where those trailer houses were in ..existence prior to `the enactment of the Zoning ordinance. ~- "Discussion-Hamlin property located at Highway 99 and Bush .Streets. -Mason instructed to"call Mr. Hamlin and refer .to the original agreement concerning the curbs, gutters. and sidewalks. ,. ._~~ '- Letter-Mayor- Saxbury read a letter from Mr. and Mrs. D. Spears, thanking .. ~ th'e.Police Department. for their courteous service .to them during investigation of a robbery at their home. High praise was given to • ~ Offi`cer .James Corliss: 3~:4 .~ e~ `~~ Mr. Mason read a letter from the State Highway Department informing..the City-they should apply for State Aid on-a City .Street again. The Council still felt that Pine Street should be listed as the Street-. on which the City needs aid.. . Mr. Mason reported he had the estimate for materials for the_ construction of the waterline extension on North Tenth Street. Materials~;;would.cost about $1,638.32. This would be transite pipe,- Water Committee is.to -check with Mr. Mason and see if the materials should be purchased at this time. - . Discussion-Storm drain. 800 feet of 30" drain pipe would cost approximately $3,100.00. Engineer recommended we.buy pipe. now; so, that more Storm drain can be installed. The Council felt that the City= should call for-Bids and go as far as our Budget would allow: • Drainage problem in the vicinity'of Cedar Street was discussed.. ,The problem was created when Mr. Whittle filled in his subdivision.`--,Hey raised the elevation so high, that rain water drains off onto ahe: adjoining properties:of Mrs.-Holt, Mr..Rivenberg and Mrs.`Gladys Long. These .people had requested that something be done about it. Mr.'. Rivenberg and adjoining property:owners..will give permission•to.dg a drain ditch down between .their property. to Freeman Road. Council authorized Mr. Capps to go ahead and dig ditch. 1 Mr. Mason presented a letter from the League, of Oregon Cities regarding the codification of Ordinances: This was information so .that the Budget Committee could consider this on the next Budget. .. M-r. Mason reported on the cost of Manzanita and Seventh Street, improvements. ..Referred to the Street Committee. A meeting to be set with the Engineer and Mr. Mason. ~ • Discussion on Street signs. Vern Capps reported he had 15 signs now, and would have. about 49, more.. Police Chief Zander was instructed: -.to :make ~a list of the signs recommended to be placed. The Council will ,act; on .them at their next meeting February 17, 19b6. Mr. P~ason reported he had received no reply from Mr. Everett Faber,, concerning the parking situation at the loading zone at Faberis Market. Attorney Mansfield was instructed to draft a letter to Donald, A. Faber, informaing him about the parking problem, and giving .him one•.,week to correct the situation. Motion by Robison, second by Adams to approve above. Motion carried.. • The Fire Department Committee gave a report in the form of a letter to the-Council, "concerning the two rooms in the Fire. Department ,formerly the kitchen and dining room.. The Police Department had requested'-:the use of these two rooms now that the Fire Department had moved their~ktchen upstairs. The Fire Committee felt the Police Department should Nave the `rooms for their-use. The report was signed by Bert Adams, John Robison and Ray Britton. D. D. Turner Sr., Fire.°Chief, stated the Fire Department had already planned to use these rooms for an office. and storage of equipment, when they completed the upstairs. Mr,. Turner realized•the Police Dept., .was short of space, just as the Fire Department was: He said. he had no objection the the Police Dept., using the office for U I ~~~ GO 1 interrogation whenever they needed it, Mayor Saxbury then instructed ?the Fire Committee and the Police Committee to meet, as soon-as~possible, to mak~e~a-final decision on the two-rooms in question. Committees .'agreed ;to meet Friday, February 4, 1966 at 7:30 P.M., in the Council Chambers. - A letter was then read from Councilman-Adams and Robison wherein they. requested.the resignation of Freeman Mason. This letter stated that ':, Mr, Mason-had overstepped his authority in demanding a copy 'of the Fire Committee.'s letter to the Council drafted by City Attorney, William Mansfield. Mr. 1'Zason denied that he had demanded this letter. Mr. ~~Mansfield, City Attorney, said there was a misunderstanding because his office had inadvertently mailed a copy of the Fire Department Committee's recommendation to Mr. Mason and Mayor William Saxbury thnkng,.it was routine City business. Councilman Adams stated that ~he had requested this letter as a private individual and`should~have - been sent to him and no one else. No action was taken on this letter. ". A letter was read from Councilman Don Patterson wherein he submitted °his-'resignation from the City Council after seven years as Councilman. =His reason. for resigning was that he is moving out of town. Motion by Bartley, second by Adams to accept Mr. Patterson's resignation. Motion carried. (Letter from Mr. Patterson attached.) John Robison said he felt the City should turn-their Fire Department over`:.to he Rural Fire Department. He felt it would save the City . -:money. .;,Attorney Mansfield said there would be legal matters to consider, and~,thE~costs might be excessive for such an operation. Motion by Robs'on~second by Adams to have the Councih instruct Mr. Robison to. investigate the costs involved in dispensing with the City Fire "department and having the Rural Fire Department take over. Roll call voter Ayes; Robison and Adams. Nayes; Bartley, Britton and Holbrook. Motion denied. Ordinance No. 810 was read, this being an Ordinance authorizing- and directing the Mayor and Recorder to execute a deed: conveying real property -as described therein. Motion by Robison, second by Bartley to approve Ord': #810. Roll call vote: All in favor. Ord. #810 declared duly- adopted. Bills were presented to the Finance Committee for approval. Motion . by~Ba~tley, second by Britton that the bills be approved and the Recorder be-.rrsturcted to draw warrants on the proper funds for paying them. Motion:carried.
