On May 11, 2010, Matt Rotolo stopped an attempted rape/kidnapping in progress along the Bear Creek Greenway. Mr. Rotolo involved himself in a potentially dangerous situation instead of going about his personal affairs. Mr. Rotolo called the police and helped apprehend the suspect, who was a registered sex offender. Attached is the completed nomination form from two City Employees. Matt Rotolo's timely intervention prevented a rape and led to the arrest of 30-year-old Ronald Allen Sohnrey on kidnapping and attempted rape charges, Medford police said. "He could have saved a life," Medford police chief Randy Schoen said as he commended Rotolo for getting involved and doing the right thing. Rotolo said he was riding south on the Bear Creek Greenway near the Rogue Valley Mall when he heard a woman scream. When he rounded a curve on the trail just south of McAndrews Road, he saw a man and woman scuffling. When the man, whom police identified as Sohnrey, a convicted sex offender, saw the approaching cyclist he began to walk away. "As I got closer, he looked eerie to me and he kept his head down so I wouldn't see his face," said Rotolo, 30. Although Rotolo had initially suspected the two might just be an arguing couple, he stopped to ask the young woman if she was OK. Shaking and crying, she struggled to speak, but told him that she heard the man, whom she didn't know, come up behind her walking faster and faster. Then, the stranger grabbed her from behind, covering her mouth to stifle her screams, and tried to drag her into the nearby bushes. Rotolo called 9-1-1 to report the attack. A dispatcher advised him what to do, and he followed the assailant under the freeway and across Biddle to a parking lot near Barnes & Noble Booksellers, providing details about the route and a description of the man he was following. As officers approached, Rotolo grabbed Sohnrey, briefly wrestling him to the ground until officers took Sohnrey into custody. Sohnrey was arraigned in Jackson County Circuit Court this afternoon. on charges of first- and second- degree kidnapping and attempted first-degree rape. Matt Rotolo's timely intervention prevented a rape and led to the arrest of 30-year-old Ronald Allen Sohnrey on kidnapping and attempted rape charges, Medford police said. "He could have saved a life," Medford police Chief Randy Schoen said as he commended Rotolo for getting involved and doing the right thing. Police credit Rotolo, 30, with helping them track down Sohnrey, a convicted sex offender who admitted to investigators Tuesday that he had been following a 24-year-old woman he didn't know along the geenway and planned to rape her, Schoen said. "This responsible citizen stopped a violent crime and helped us apprehend the suspect so he is held responsible and doesn't have a chance to victimize others," the chief said. "It was one of those meant-to-be things," Rotolo said of his timely arrival and quick response. At about 2 p.m. Tuesday, the woman was walking north on the bike path along Bear Creek on her way to Target, reading a book as she strolled, police said. Sohnrey told police that he saw her near Fourth Street and began following her.. The woman said she had heard footsteps behind her growing closer and closer, and she expected the other walker to pass her. Instead, he grabbed her from behind, putting his hand over her mouth to stifle her cries, and pulled her east, toward brush along the creek. "I pulled his hand off my mouth so I could scream as much as possible," the woman told the Mail Tribune Wednesday. A 9-1-1 dispatcher gathering details about the incident advised Rotolo what to do as he got back on his bike to follow the assailant. He trailed the suspect under the freeway and across Biddle Road to a parking lot near Barnes & Noble Booksellers, providing details about the route and a description of the man he was following. Both Rotolo and the woman said Sohnrey wallced away cahrily, almost as if nothing was out of the ordinary. "He was getting more nervous as I followed him," Rotolo said. When it looked as though Sohnrey might bolt as police approached, Rotolo grabbed him,. briefly wrestling him to the ground until officers took over. "I have six sisters and it bothers me to know that there are people like that," Rotolo said. Sohnrey was arraigned in Jackson County Circuit Court Wednesday afternoon on chazges of first- and second-degree kidnapping and attempted first-degree rape. He remained lodged in Jackson County Jail Wednesday on ~ 1 million bail. "Now that I know that he got caught, I feel safer," said the woman, who recently moved to Medford and works downtown. She said she had walked along the greenway regulazly in the past month, but now she would be more wary. "I know the chances of this happening again are slim, but walking on the bike path won't be the leisurely activity it once was," she said. Schoen said the greenway is "statistically safe," reiterating that other streets in town have mare criminal activity. "This could have happened in any parking lot," he said. However, he described the midday attack as "horribly brazen." "This reminds us why we track sex offenders and why we are committed to that cause," Schoen said, noting that Medford police have one of the most active programs in the state for monitoring sex offenders and arresting those who fail to register as required. Court records show that Sohnrey has been arrested seven times for failing to report his address since he was first required to register as a sex offender in 2004. Ina 2004 sexual abuse case, he pleaded guilty to attempted sexual penetration with a foreign object. Resolution o. 1261, A Resolution Certifying the Provision of unicipal Services by the City of Central Point, ®regon Finance Director Bev Adams stated. that the proposed resolution certifies the provisions of city services. The resolution. is required by the state in order for the City to receive state cigarette, liquor, and highway taxes. The City expects to receive $1,055,000 from these resources. Resolution ldo. 1264, Resolution Increasing the Sto Utility Fee Interim Parks and Public Works Director Matt Samitore stated that Central Point Municipal Code 11.16.060 states that the Council may adjust the Stormwater Utility Fee as needed. The Council set a beginning rate of $5.00 per equivalent service unit in 2006 when it was introduced. The rate was intended to be increased once studies were complete and the Capital Improvement. Plan was adopted. Because of the economy and the lack of construction at that time, the council decided not to increase the fee. A revised Capital Improvement Plan indicates that an increase in the Stormwater Utility Fee is needed in order to work on larger projects. The current fee of $5.00 a month covers cleaning and maintenance of the current system. It does not provide enough funds to fix areas that are damaged. The 2010/11 Budget was approved with this fee at $6.50 per equivalent service unit. Mayor Williams opened and closed the public hearing. IVo one came forward. Council is not in favor of increasing fees. IJSI ESS Planning Cornrnission Report Community Development Director Tom Humphrey reported that the Planning. Commission discussed the C-4 Zoning District Amendments. Planning Manager Don Burt went over the basic concepts for proposed changes to the C-4 zoning district with emphasis on design. elements. Staff sought the Commission's input so that their ideas could be discussed at a meeting with the business group. The Commissioners expressed concern about the City becoming to theme oriented like Jacksonville and hoped that the new design criteria would allow for some individuality in construction. The Commission agreed that walk-ability and human scale were necessary components of a new code but that the concept of transparency in building design should be limited to 40% overall. YR°S REP®RT Mayor Williams reported that he attended the Rodeo, an Adhoc meeting to discuss the management compensation plan, and lunch with delegates from China. X. CITY I IST T®12'S REP®RT City Administrator Phil Messina reported that ® He attended the Ledford Water Commission meeting with Lr. Samitore. They will be researching water rights and the need to purchase them. ® Assistant City Administrator Chris Clayton will be in charge of the Study Session on June 21, 2010. ® He will be out of town at the end of next week. XII. C®IJNCIL REP®RTS Council Lember Latt Stephenson reported that: ® He attended an AdHoc Leeting on the management compensation plan. ® He attended a SOREDI meeting where they had a presentation regarding classes specifically geared towards making wine. It was expressed that Oregon.. has a good environment for growing grapes and making wine. This group may approach local cities to help with funding. ® Council received a letter from a local church with. concerns about holding the 4~' of July parade during church service times. He is concerned about the conflict. Lr. Samitore stated that City and Chamber members contacted the local churches months ago to discuss options. The group made the decision to hold. the parade on the 4~' of July. The last time the 4~ of July was on a Sunday the parade was held on Saturday. That decision was not popular with many citizens and Veterans groups.. Every six years this occurs and neither decision is the best for everyone. Council Member Carol Fischer reported that she attended the unveiling for Compass Plaza and a SOREDI presentation for the Chinese Delegation. Council Member Allen Broderick reported that he attended the Lanagement Compensation AdHoc Committee meeting. They are looking for sustainability grants to help with funding once the process is complete. ® Attended an RVTD meeting. ® Attended ACT meetings regarding the unique transportation challenges in the Rogue Valley. ® Will be out of town for the Council meeting on July Stn xlu. ~~~ T RI=1P ~s Finance Director Bev Adams stated that they will be printing the final budget document in the next few weeks. If Council member are not interested in receiving a copy please let staff know. Community Development Director Tom Humphrey stated the Study Session will be about the RPS Presentation to the County and recommended Charter revisions. Interim Parks and Public Works Director Matt Samitore reported that: ® They are almost complete with the Alderwood water meter replacement. ® The Vilas Road water line project should be complete next week. ® The Don Jones Pedestrian Crossing should be finished early in July. ® He attended the Medford Water Commission meeting with Mr. Messina. They will be researching the need for water rights. ® The Memorial Day event was well attended. ® The Parks Department held the unveiling for the Compass Plaza by Crater High School. ® They have turned the water on for the Spray Park, the weather should start warming up soon. Matt Stephenson asked about a letter the Council received from Sandy Dennis, a Yoga instructor for the recreation. program, regarding the issue with Adam Holtey. Mr. Stephenson stated that he was under the impression that this issue was already taken care of. Mr. Clayton stated that Mr. Holtey will be working with Mr. Messina and himself due to the fact that his spouse works for the City. A meeting has been arranged for Mr. Holtey to come to city hall. Mr. Holtey indicated that he has some ideas that will benefit. all involved. The Council stated that they are not in favor of changing the recreation classes or policy because of a potential conflict with businesses. They agreed that there could be other businesses in town. that have a conflict. It is not reasonable to ask the city to forgo the classes because a business may have a conflict. Assistant City Administrator Chris Clayton stated that he will have a resolution ready for Council. regarding the Charter revisions at the July 8cn Council meeting.. O~Jar . City staff also keeps track of outdated and unnecessary code requirements that should be changed. In this case, there are two sections in Chapter 15, Building and Construction that are being proposed for amendment. These are Section 15.04.010, Standards applicable to building and Section 15.22.030, Setback requirements. ISCiJSSN P®~1TSe The State of Oregon has passed legislation that necessitates the following changes to the Central Point Municipal Code, Section 15.04.010.. These include replacing references to state building codes dated 2002 - 2007 with more recent references dated 2006 - 2010 respectively, adding Appendix G, Flood-Resistant Construction and adding 2010 Oregon Energy Efficiency Specially Code based on 2009 IECC. In Section 15.22.030, staff has discovered that the twenty foot (20') setback requirements from a swimming pools' edge of water to a Bade or rear property line contiguous with a street right-of--way is no longer necessary. This requirement existed in the past when it was thought that the city might need additional right-of--way at some point in the future. However, the city now formulates street widths and acquires all right-of--way at the time of subdivision. A RESOLUTION SCHEDULING BIENNIAL ELECTION OF CENTRAL POINT CITY OFFICERS ON NO~JE ER 2, 2010 WHEREAS, the Central Point City Charter provides that regular City elections shall be held at the same times and places as biennial general state elections, and the next biennial state election is scheduled for November 2, 2010; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. The biennial election of the City of Central Point, Oregon, shall be held concurrently with the general election of the State of Oregon on November 2, 2010, between the hours of 7:00 a,m. and 8:00 p.m. Pacific Standard Time, at which election the City shall elect a mayor, one council member from Wazd I, Wazd II, and Ward III. Section 2. The precincts and judges and clerks of election shall be the same as those provided within the City of Central Point, Oregon, for the statewide general election held on the same date. Section 3. The City Recorder is hereby authorized and directed to give notice of said election, at least 10 days prior to the election, by posting notice thereof in a conspicuous place in the City Hall and in one public place in each voting precinct of the City. The notice shall state the officers to be elected, the ballot title of each measure to be vated upon and the time and place of the election. Section 4. Position Classification Pay Plan SU AitY: Resolution No. ratifies and adopts the revised Classification Pay Plan, adjusting the monthly salaries for City positions. Part A of the pay plan (General Service Bargaining Unit) reflects an increase of 3.3% to the current salary scale. The collective bargaining agreement ratified in October, 2007 includes an annual cost of living increase based on the January to January CPI-W figure with a minimum of 3% and maximum. of 4%. The CP1-W January 09 to January 10 was 3.3%. Additional changes to Part A of the pay plan include removal of three inactive positions and the addition of two new position titles. Custodial Services Technician became inactive upon the contracting out of these duties; Public Works Supervisor is inactive due to the reorganization of the Parks and Public Works department; and Parks Maintenance Supervisor was made inactive following the removal of supervisory duties and subsequent reclassification of that position to "lead." All supervisory responsibilities have now been removed from General Service Bargaining Unit positions and fall within the scope of management level positions. The added job titles are Recreation Coordinator: Special Events and Marketing, and the additional Parks Lead position. Parks now has two lead positions: one is specific to Parks Maintenance and the. other is specific to Contracts and Special Events. Part B of the pay plan (Police Bargaining Unit Positions) does not. reflect any changes to the 2009-2010 salary scale. The police bargaining unit agreed to extend the 2007-2010 bargaining agreement language for eighteen months, foregoing any cost of living increase for 2010-2011. In the extension agreement is a provision to reopen for a cost of living adjustment after one year (prior to July 1, 2011). Part C of the pay plan (Non-Bargaining Unit, Management Positions} reflects a cost of Living increase of 2% on the 2009-2010 salary scale. Additionally, the top of the "E195" range was increased from $7,545 to $8,500 following discussion by the ad hoc committee reviewing a proposed management compensation plan. That plan is scheduled to come before the Council on July 22, 2010. With the exception of the non-exempt Accountant position, Part C of the pay plan was not increased by a Cost of Living Adjustment in 2009-10. Due to the reorganization and combination of the Parks and Public Works Departments, the Recreation Supervisor position was "folded into" the Parks and Recreation Manager job and the Public Works Supervisor and Field Operations Manager positions were combined to create the Public Works Operations Manager job. Additionally, the Planning Manager and Police Project Assistant. positions were removed from the pay plan because they, along with the Safety Training and Emergency Planning Coordinator position, are part-time, contracted positions that are paid at an hourly rate negotiated in an individual employment agreement.
