BOARD OF COMMISSIONERS, hereinafter known as "JACKSON COUNTY, " and the CITY
OF CENTRAL POINT , an incorporated city with JACKSON COUNTY, State of
Oregon, hereinafter known as the "CITY."

WITNESSETH.
WHEREAS, ORS 206.345 (1) provides:
"A Sheriff shall have authority to enter into
contracts, jointly with the governing body of the
County, on behalf of the County, as provided in
ORS 190.010."
AND WHEREAS,
The CITY does not have sufficient jail facilities in which to keep
Prisoners under sentence by Municipal Court for a period exceeding twenty- t
four hours, and desires to contract with JACKSON COUNTY for the custody, control,
security, boarding, and general welfare of CITY prisoners under sentence by
Municipal Court for a period exceeding twenty-four hours; and
WHEREAS, the CITY and JACKSON COUNTY desire to enter into a contract
whereunder and whereby JACKSON COUNTY shall assume the control , custody; security,
boarding and general welfare of CITY prisoners under sentence by Municipal Court
for a period exceeding twenty-four hours;
NOW, Tt=EFORE, in consideration of the premises, the parties Leretc
do hereby agree that:
I.
That JACKSON COUNTY shall, upon notice to its Sheriff or delegated
subordin1te, accept delivery of prisoners of the CITY OF CENTRAL POINT
which are under sentence by Municipal Court for a period exceeding twenty-fear

of control of said prisoner to the JACKSON COUNTY SHSRIFF or his delegated
subordinate. The CITY, pursuant to Oregon Revised Statutes, WS) Chapter 169,
acknowledges the authority provided under the statutes herein identified, and
that any prisoner delivered to and lodged in the JACKSON COUNTY Jail shall
be under the absolute and exclusive control of the Board of Commissioners
df JACKSON COUNTY.
III.
That as consideration for JACKSON COUNTY assuming control custody,
security, boarding and general welfare of said prisoners, CITY shall pay
$10.00 per day, or any part of a day, in which JACKSON COUNTY has
custody of each prisoner; said payments to be made at the close of each month
based upon a statement containing the number of prisoners and days in custody
shall be submitted on or before the 10th of each month in which JACKSON COUNTY
has custody of the prisoners.
IV.
If medical care is required for any CITY prisoner in custody
of JACKSON COUNTY, in the judgment of the Sheriff or his delegated subordinate,
then CITY shall pay any and all medical expenses reasonable incurred for said
prisoner. The statement for medical services rendered shall be submitted
with and as part of the statemert referred to in Paragraph III. In the
event a competent medical doctor shall deem it necessary that any prisoner
in the custody of JACKSON COUNTY for the CITY shall be required to be
hospitalized, then, and ip that event, it shall be the duty and obligation
of the CITY to furnish adequate guards for the custody of said prisoner
while in any hospital.
V.
This contract shall be in full force and effect commencing the
date thin instrument is signed and continuing until revolted by either party
upon thirty days of written notice. This contract may be modified at any
time by the agreement of the p-+rties.
