HomeMy WebLinkAboutDA 01-52388* 3° ,o 01 52388 \\ WORK GUARANTY AGREEMENT This agreement, made and entered into this . i day of July, 2001, Between City of Central Point, Oregon, an Oregon Municipal Corporation, hereinafter referred to as "City", and Van Wey Homes, Inc., and Key West Properties, hereinafter referred to as "Developer"; WITNESSETH Recitals: Developer has previously been granted tentative plat approval by City for New Haven Estates Subdivision, Phases VI and VII. A. Developer has now applied to the City for final plat approval for said development. B. Developer has constructed all improvements required by the tentative plat and City requires Developer to guaranty said work for a period of two years; NOW THEREFORE in consideration of City giving final plat approval unto Developer for said New Haven Estates Subdivision, Phases VI and VII, Developer hereby agrees, for a period of two years that all improvements installed pursuant to the tentative plat approval shall be free from defects in material and workmanship. Prior to the expiration of said warranty period, City shall determine if any materials or workmanship deficiencies exist, and such at City's request, Developer shall repair or cause the repair of all such deficiencies. In the event that the Developer does not repair or cause the repair of any such deficiencies to be performed and shall seek such remedies available from the Developer to recover all costs expended to complete the necessary repair work as described herein. In the event there are no deficiencies, or upon approval of any necessary repairs, City shall issue a written document certifying developers satisfactory completion of warranty.
