HomeMy WebLinkAboutCouncil Resolution 1152RESOLUTION NO. l / 5 ~., A RESOLUTION DEDICATING A PORTION OF DON JONES PARK TO PUBLIC RIGHT-OF-WAY WHEREAS, the City Council has previously approved the Planned Unit Development known as Four Seasons Subdivision with access to North Mountain Drive and West Vilas Road; and WHEREAS, the developer Heritage Development, Inc. has agreed to pay for the full construction of the Basketball Court within Don Jones Park in exchange for the right-of--way. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, that the attached Exhibit 'A' detailing the area to be dedicated for future right-of- way. ~~ Passed by the Council and signed by me in authentication of its passage this day of June, 2007. ~ Mayor Hank Williams ATTEST: City Recorder Approved by me this ~ rd of ~'+~. 2007 ~. ~~~'~ d Mayor Hank Williams EXHIBIT "f~" AREA DESCRIPTION FOR FUTURE RIGHT-OF-WAY All that real property located in the Northwest One-quarter of Section 1, Township 37 South, Range 2 West of the Willamette Meridian, in the City of Central Point, Jackson County, Oregon. The exterior boundary of which is more particularly described as follows: Commencing at an angle point of the right-of-way of North Mountain Avenue, also being the Northwest corner of Lot 225 of Central Point East Development, Phase 7, recorded January 6, 2002, in Volume 28 of Plats at Page 1 of the Records of Jackson County, Oregon, and filed as Survey Number 17167 in the office of the Jackson County Surveyor; thence along the north right-of-way line of said North Mountain Avenue, South 89°44'10" West, 30.59 feet to the True Point of Beginning; thence continuing along said right-of-way, South 89°44'10" West, 41.30 feet to the beginning of a curve concave to the northwest, having a radius of 20.00 feet and a central angle of 89°40'30" (the long chord of which bears North 44°53'55" East, 28.20 feet); thence along the arc of said curve, 31.30 feet; thence tangent to said curve, North 00°03'40" East, 24.11 feet; thence North 89°44'10" East, 21.42 feet to a point on the east line of Instrument Number 99-37498 of the Official Records of Jackson County, Oregon; thence along said east line, South 00°04'13" West, 44.00 feet to intersect aforesaid north right-of-way line of North Mountain Avenue, and the Point of Beginning. Containing 1,027 square feet, more or less. Basis of bearings for this description is the centerline of Vilas Road per Survey Number 15762, as filed in the office of the Jackson County Surveyor.
