RESOLUTION NO.1�
A RESOLUTION DECLARING THE NECESSITY TO CONDEMN CERTAIN REAL
PROPERTY FOR STREET IMPROVEMENTS SCENIC, UPTON, TENTH, AND THIRD
STREETS
1. The City wishes to construct certain street improvements along Scenic, Upton,
Tenth, and Third Streets. Acquisition of certain real property described on Exhibit "A", attached
hereto and by this reference incorporated herein, is necessary to carry out such street
improvements.
2. Attempts to acquire the needed property by negotiation with the owner of the
property are in process, but not guaranteed.
3. In order to ensure property acquisition for public improvements and to not jeopardize
state funding; the City must proceed with a resolution declaring the necessity to condemn.
4. ORS chapter 35 empowers cities to acquire by condemnation real property
whenever in the judgment of the city there is a public necessity for the proposed use of the
property, the property is necessary for such proposed use and the proposed use is planned or
located in a manner which will be most compatible with the greatest public good and the least
private injury.
Now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT,
OREGON AS FOLLOWS:
SECTION 1. Central Point hereby declares its intention to acquire by condemnation
that certain real property described on Exhibits "A" for the purpose of construction certain street
improvements.
SECTION 2. The City finds that there is a public necessity for the construction of such
street improvements, that the property described on Exhibit "A" is necessary therefore, and that
the proposed street improvements are planned and located in a manner which will be most
compatible with the greatest public good and the least private injury.

A parcel of land {ying in the NEY of Section 3, Township 37 South, Range 2 West of the
Willamette Meridian, in Jackson County, Oregon and being a portion of that property
described in that Warranty Deed to Norman S. Tresser and Surry E. Tresser recorded
December 23, 2004 as Document No. 2004-074203 and that Special Warranty Deed to
Daniel A. Kahn and Karen Kahn recorded March 18, 2005 as Document No. 2005-014920
of the Official Records of Jackson County; said parcel being that portion of said property
included in a strip of land variable in width lying on the Easterly side of the relocated center
line of North 3rd Street, which center line is described as follows:
Beginning at Engineer's center line Station 0+00.00; said Station being 1,000.52 feet
South and 1,408.52 feet East of the North 'f corner of Section 3, Township 37 South,
Range 2 West, W.M., thence South 40x38'19" West 40.15 feet; thence along a 200.00 foot
radius curve to the left (the long chord of which bears South 21 00'03" West, 134.43 feet)
137.10 feet; thence South 01 21'47" West, 160.73 feet to Engineer's Station 3+37.97.
