RESOLUTION NO. ~ ~~~
A RESOLUTION DECLARING THE ANNEXATION
OF 7.4 ACRES OF LAND LOCATED ON THE NORTH OF LIPTON ROAD AND
SOUTH OF SCENIC AVENUE, INTO THE CITY OF CENTRAL POINT, OREGON
(Applicant(s): City of Central Point
(37 2W 03AB; Tax Lots 100 and 4700)
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT,
OREGON, AS FOLLOWS:
Section 1. Application has been made by the owners of certain real property for
annexation into the City of Central Point, Oregon. The property consists of two tax lots and road
right-of--way totaling approximately 7.4 acres. The property to be annexed is more particularly
described as follows:
Beginning at the Westerly most corner of Lot 32 of Summerfield Subdivision, located in the Northeast
quarter of Section 3, Township 37 South, Range 2 West of the Willamette Meridian, Jackson County,
Oregon, said subdivision Plat Filed as survey number 15802 in the Office of the Jackson County
Surveyor, thence leaving said subdivision boundary, South 33°18' 17"West, 72.37 feet to a point on the
Southwesterly right-of way of Tenth Street; thence along said right-of way, as described in Instrument
Number 2003-35533 of the Deed Records ofsaid County, North 41°46'42"West, (record North
42°01'25"West) 492.97 feet to the Northeast corner of the tract of land as described in said Instrument,
also being on the Southerlyright-of--way of Scenic Avenue; thence along said Southerly right-of--way,
North 70°42' 13"West, 176.84 feet (record North 70°18' 15"West, 176.29 feet) to the Northwest corner
of said tract also being the Northeast corner of Parcel 1, as described in Instrument Number 2005-
000239 ofsaid deed records ;thence leaving said Southerly right-of--way, along the Easterly boundary of
said Parcel 1, South 00°04'06" West, 290.50 feet (record South, 290.5 feet) to the Southeast corner of
said Parcel l; thence along the Southerly boundary of Parcel 1 and Parcel 2 of said Instrument Number,
North 70°14'42"West, 317.80 feet (record North 70°45'West, 3]7.80 feet) to the Southwest comer of
said Parcel 2; thence leaving said Southerly boundary, North 00°04'35"East, along the West boundary of
said Parcel 2, a distance of 290.61 feet (record North, 290.50 feet) to the Northwest corner of said Parcel
2, also being the Southerlyright-of--way line of Scenic Avenue; thence al n~ aid right-of--way line,
North 70°08'36" West, 82.85 feet; thence leaving said right-of--way line,~9°46' 13" East, 59.62 ~'
feet, to the Southwest corner of Lot 20 of Scenic Village Subdivision, as filed in the Office of the
Jackson County Surveyor as Survey Number 5957, thence along the South boundary of said subdivision,
also being the Northerly right-of--way line of Scenic Avenue, South 70°13'47"East, 409.66 feet to the
Southern most corner ofsaid subdivision; thence leaving said Southerly boundary, North, along the East
Boundary of said subdivision 215.83 feet; thence '89°55'53"East, along the North boundary of the'
tract described in Instrument Number 2006-061030 ofsaid Deed Records, 75.57 feet; thence North
24°24'37" East, 195.00 feet; thence North 06°27'41"East, 60.00 feet to a point on the Westerly right-of-
way line of Upton Road; thence East along said right-of way line, 5.00 feet; thence along the
Northwesterly right-of--way of Upton Road, along a 250.00 foot spiral curve to the right, the long chord
of which bears, North 25°34' 16" East, 259.78 feet to the intersection with the Southwesterly right-of-
way line of Interstate 5; thence along said Southwesterlyright-of--way, South 45°00'50"East 180.30 feet
to the Northern most corner of said Summerfield Subdivision; thence along the Easterly right-of--way
line of Upton Road as follows, South 52°39'05"West, 87.09 feet; thence South 24°54'05"West, 12.31
feet; thence South 23°00'20"West, 180.70 feet; thence South 04°01'02"West, 69.67 feet; thence South
00°18'25"West, 70.28 feet; thence South 00°00'58"West, 292.94 feet; thence along the arc of a curve to
the left, having a radius of 100.00 feet, an internal angle of 41°58'35" and an arc length of 73.26 feet
(the long chord of which bears South 20°58' 19"East, 71.64 feet); thence continuing along said Easterly
right-of--way line, South 41°57'37"East, 334.37 feet to THE POINT OF BEGINNING.

The above described property is not within the City of Central Point's
Current corporate boundaries, but is contiguous to the City's existing corporate boundary and is
within the Central Point Urban Growth Boundary (UGB).
Section 2. The owners of the property proposed for annexation are the City of Central
Point and Janet Goodrich, and there is sole consent to the annexation. Such written consent is on
file at Central Point City Hall, 140 S. Third Street, Central Point, Oregon.
Section 3. ORS 222.125 provides that when all of the owners of land in the territory
proposed for annexation and not less than 50% of the electors residing in such territory have
consented in writing to the annexation of the land in the territory and file such written consent
with the City Council, the property may be annexed without the requirement for an election or a
public hearing.
Section 4. Annexation of the described property is consistent with the City's ability to
provide facilities and services to the real property, as required by the City's Comprehensive Plan.
Section 5. Pursuant to ORS 222.125, the property described in Section 1 above, shall be
and hereby is, annexed to and made part of the City of Central Point, Oregon.
Section 6. The City Administrator, or his designee, shall transmit a copy of this
resolution to the Oregon Secretary of State, and this annexation shall be effective when filed with
the Oregon Secretary of State pursuant to ORS. 222.180.
