HomeMy WebLinkAboutCouncil Resolution 1127RESOLUTION N0. A RESOLUTION AMENDING THE CITY'S POLICIES ON FEES AND DEPOSITS FOR USE OF CITY PARK FACIITIES Recitals 1. The City Council previously adopted Resolution No. 740, A Resolution Amending the City's Policies on Fees and Deposits for Use of City Park Facilities. 2. Due to a need to offset increases in maintenance costs, damage due to vandalism and wear and tear on existing parks due to increased usage. Now, therefore; BE IT RESOLVED BY THE CITY COUNCYL OF THE CITY OF CENTRAL POINT, OREGON, that the City's policies on fees and deposits for residents and non-residents' use of City park facilities set forth in Resolution No. 740 is hereby amended, so that the entire text of the City's policies is as follows: Section 1. Definitions. Applicant - Any person(s) at least twenty-one (21) years of age with proper credentials (i.e., valid driver's license, O.L.C.C card, etc.). Clean-up Deposit - A monetary charge posted by applicants and kept by the City if the applicant fails to reasonably clean up the facility after use. This fee is refundable upon approval by the Director or designated staff person. Director ~ Parks and Recreation Director for the City of Central Point, or a person designated by the Director to carry out certain functions. 4th of July Celebration - The actual date of the 4th of July celebration is held in Pfaff Park. Reservation - The reserving of a specific areas or facility in the parks for a specific time or date. User Fee - A monetary charge for the use of the facility being reserved, and used to offset costs incurred for providing this service. Payable by both residents and non-residents of Central Point upon making reservations. Section 2. General. Information and Special Conditions. A. Reservations of park facilities may be applied for no more than 180 days before the requested reservation date. Pfaff Park is reserved for the 4th of July celebration each year by the Chamber of Commerce, and no other reservations will be allowed for Pfaff Park on the 4th of July celebration date, unless authorized by the City Council. No user fee or clean-up deposit shall be charged to the Chamber of Commerce for the 4th of July celebration. B. Both citizens and/or businesses located within the incorporated limits of Central Point and those located outside the incorporated limits of Central Point may reserve park facilities for specific date and time through application to the City. Residents and nonresidents will be charged a user fee. A clean-up deposit will be charged to both residents and nonresidents. If a city key is required, a key deposit will be charged to both residents and nonresidents. C. The applicant shall be responsible for leaving the reserved area in clean condition and ready for use by the next reserving party. If the Director determines the area was not left in clean condition, the clean-up deposit will not be refunded to that applicant. D. If a city key is required for a reserved venue, a $25 deposit will be required. Deposit will be returned when key is turned in to the appropriate city department. E. In case of special requests, fees for special equipment and /or personnel used to complete the request of the applicant will be collected at the time a reservation application is issued to the applicant. F. The reservation shall be effective when all deposits and fees have been paid. G. Cancellation of a reservation shall be made at least ten (10) working days prior to the date of the reservation, or all deposits and fees shall be forfeited. H. Any persons seeking a refund of user fees, a clean-up deposit or because of inability to use facilities as reserved shall submit a written statement or refund request to include: (1) Name of group, address and telephone number; (2) Name, address and telephone number of person group to receive refund; (3) The reason for seeking refund .and the amount requested. No refunds shall be made unless approved by the Director. I. All reservations are on a first come, first served basis. Reservations will be accepted for the hours between 8:00 a.m. and 8:00 p.m. shall require City Council authorization. Section. 3. Establishment of Fees and Deposits. City. For reservations of areas in any City park, a clean-up deposit and key deposit will be charged as described in Table 2: Table 2. Deposits Cleaning Deposit (Required Refundable Deposit based on for both residents and total number attending: nonresidents) $75 - 1 to 49 attending $100 - 50 to 99 attending $125 - 100 to 149 attending $150 - 150 to 250 attending Fee determined by Director for events with over 250 attending Key Deposit (Required for $25 deposit required when a key both residents and is loaned out to residents and nonresidents) a$35.00 fee is required for nonresidents. Deposit returned when key is returned. C. In the event that a user of park facilities damages any city property or fails to leave the facility in a clean condition, City shall collect from such user an amount of money, over and above the amount of the clean-up deposit, deemed necessary by the Director to repair or clean up the facility. D. In the event that a user shall use a facility for a period longer than the time reserved by such user, the City shall collect a user fee for the additional time. If one user exceeds his or her time, causing the following user to use less than his or her entire reserved time, the fee for the unused time may be refunded. Section 4. Classification of Fees. For purposes of ORS 310.145, and ORS 305.580-591, the fees and deposits described in this resolution are classified as "other fees not subject to the limits of Section llb, Article XI, of the Oregon Constitution".
