'Contractor" agrees to indemnify and save harmless City and their officers, employees, agents, and City's other contractors or contractors from and against any and all liabilities, losses, penalties, fines, claims, costs, and expenses incidental thereto (including costs of defense, settlement, and reasonable attomeys' fees), which any or all of them may hereafter suffer, incur, be responsible for, or pay out as a result of bodily injury (including death), property damage, contamination of or adverse effects on the environment, or any violation or alleged violation of statutes, ordinances, laws, orders, rules, or regulations, (a) to the extent caused by "Contractor's" breach of this Agreement or by any negligent act, negligent error or omission, or willful misconduct of "Contractor" or its employees, agents, or "Contractor's" subcontractors in the performance of this Agreement, and/or (b) arising out of the performance of work and services with respect to this Agreement. TAX UABIUTY The City shall not be liable for any withholding, social security, or income tax imposed upon the provider arising out of, or in any way related to, the performance of services under this Agreement. CONTRACT TERIN/NATION The provider and the City agree that the City may terminate this Agreement at any time, for any reason, by giving the provider actual notice of termination. The project, as outlined by Corey in our meeting on March 7th, involves the use of both pre and post emergent herbicides in combination with a nitrogen fertilizer to improve the quality and aesthetics of the turf grass at the city parks. Greenway Spray LLC is committed to safely applying herbicides with the least amount of environmental impact by using products that will best control the target according to their site. We are licensed through the Oregon Department of Agriculture, bonded and insured. Pesticides will not be sprayed on ground that is wet by rain or irrigation runoff. Reasonable buffers will be in place for all areas with water including streams, springs, irrigation runoff and riparian areas. Native plants and trees will NOT be sprayed, only the areas previously approved and planted with turf grass. Greenway Spray is a safety first company, and we supply our team with up to date training in pesticide handling and application. I have an extensive background in herbicide and fertilizer selection and application, and will be on this project throughout. We will be posting the turf grass areas 48 hours prior to any pesticide application at the park entrances. This is to ratify the public of the work that will be taking place. Greenway Spray will be placing flags, as we progress through the parks, warning visitors that the area is off limits until the spray has dried. We will also coordinate with your office as to the date, time and the method of application. Below are the products that we have chosen to use and why we think they would best suit your needs. - The primary weeds this time of year are broadleaf. We have chosen a product by Helena called On - Deck. On -Deck is a specialized combination of 2,4-d add and Dicamba acid that will achieve excellent results this time of year. This is the only product on the market that uses the acid form of these chemicals. The benefit of the acid is this herbicide is the least likely of the phenoxy herbicides to volatize or move off target. In looking at the product selections you sent me earlier this week, there wasn't a pre -emergent herbicide used the last two seasons. This being the case, I would recommend Resolute by Syngenta. This is a good choke for broadleaf and grassy weeds in Perennial Rye turf. Resolute will give pre - emergent activity for approximately five months. There are many pre -emergent products that can target specific weed seeds. As we go through the summer I'll make notes so we can adjust the chemistry of the pre -emergent to target your specific weed needs in fail and early next spring. The fertilizer selection I would recommend is UNK 240.2 by Wilbur Ellis. This product is 15% slow release nitrogen and in most cases won't bum the turf when applied by spray. By using Wilbur -Ellis 24-0-2 we can supply your turf with three times the amount of nitrogen as the 20-20-20 that has been used over the past two years. For safety, Greenway Spray will use the best surfactant package on the market. We would use Crosshah by Wilbur -Ellis for our drift control. The Rogue Valley has seen many cases of off target applications and we won't be one of them. For our spreader/sticker we would use Super Spread 7000. I noticed in the email you sent with the previous products used on the parks that the city did a summer application for nut sedge. One of my accounts is the turf farm in Grants Pass and we have had excellent results using different chemistries for nut sedge control. Let me know as we get closer to summer if this is an application that Greenway Spray provide. All fertilizer and pre -emergent treatments need to be watered in after they are applied. To reduce the risk of harming the turf, we highly recommend that all turf areas are irrigated following applications. The attached estimate is made up of two pricing structures. The small parks are priced as individual line items and the larger parks are priced by the acre. Greenway Spray selects the products we use by how they perform, not by how much they cost. If you feel the need, I am always willing to negotiate the price of an estimate. Greenway Spray LLC has a 20' boom sprayer that has a GPS guidance system for precise even application. We are set up to spray large turf areas. With favorable weather we don't see this project taking more than three days to complete. Our schedule is booked tight this spring. Upon approval, and a written notice to proceed, we will coordinate with your office to get the herbicide application done within three weeks.
